Unit Nos. It hereby is confirmed that each tenant currently residing in a unit in the Project has completed an Income Certification Form in the form approved by the City and that since commencement of the Qualified Project Period, not less than 40% of the occupied units in the Project (excluding the manager’s unit) have been rented to (or are vacant and last occupied by) Qualified Tenants. The undersigned hereby certifies that the Owner is not in default under any of the terms and provisions of the above documents.

Unit Nos. It hereby is confirmed that each Low Income Tenant currently residing in a unit in the Project has completed an Income Computation and Certification in the form approved by the Issuer and that since commencement of the Qualified Project Period at least forty percent (40%) of the occupied units in the Development have been rented to (or are vacant and last occupied by) Low Income Tenants, as required by Section 4(a) of the Regulatory Agreement.
Unit Nos. It hereby is confirmed that each Very Low Income Tenant currently residing in a unit in the Project has completed an Income Certification Form in the form approved by the City and that since commencement of the Qualified Project Period (as such term is defined in the Regulatory Agreement), not less than 100% of the occupied units (excluding the managers’ units) in the Project have been rented to (or are vacant and last occupied by) Very Low Income Tenants or an Existing Tenant. The undersigned hereby certifies that the Owner is not in default under any of the terms and provisions of the above documents.
Unit Nos. It hereby is confirmed that each tenant currently residing in a Restricted Unit (as that term is defined in the Regulatory Agreement) in the Project has completed an Income Certification Form in the form approved by the City and that since commencement of the Qualified Project Period (as such term is defined in the Regulatory Agreement), of the occupied units (excluding at least one manager’s unit), if any, in the Project have been rented to (or are vacant and last occupied by) Very Low Income Tenants and DRS Tenants. The undersigned hereby certifies that the Owner is not in default under any of the terms and provisions of the above documents.
Unit Nos. Square Footage. The Units have the unit numbers and square footage set forth in the Basic Infonnation and in Exhibit A; provided, however, that any statement of square footage set forth in this Agreement, or that may have been used in calculating any of the economic tenns hereof, is an approximation which City and Concessionaire agree is reasonable and no economic terms based thereon shall be subject to revision whether or not the actual square footage is more or less. The location and dimensions of the Units are depicted on Exhibit A-l, which is attached hereto and incorporated herein by this reference.
