Common use of Unjust Discipline Clause in Contracts

Unjust Discipline. Where it is determined that an employee has been disciplined in violation of Article 10, that employee shall be immediately reinstated in his former position without loss of seniority or any other benefit which would have accrued to him if he had not been disciplined. One of the benefits which he shall not lose is his regular pay during the period of discipline which shall be paid to him at the end of the next complete pay period following his reinstatement, or by any other arrangement as to compensation which is just and equitable in the opinion of a Board of Adjudication or Adjudicator, if the matter is referred to such a Board of Adjudication or Adjudicator.
