Student Discipline. A. The Board of Education and the Association agree that effective pupil control and discipline is prerequisite to effective teaching and learning. The staff and administration shall be responsible to handle and correct the behavior of any student who disregards school rules and regulations. B. Any pupil who is dismissed for disciplinary reasons from a classroom or teaching station shall be directed immediately to the appropriate school administrator. C. Any unit member who refers a pupil to a school administrator for disciplinary action shall, that same day, submit a discipline referral report to the school administrator in charge of discipline. One of the copies shall be placed in the pupil’s file and one copy shall remain in the principal’s office. This report shall include a statement of facts, a summary of the historical conditions preceding the event which resulted in disciplinary action, the steps taken by the unit member to remediate the perceived problem and to motivate the student involved, and a statement describing the disciplinary steps taken by the unit member before referral to the school administrator. D. Administrators and unit members shall assume responsibility for the education and control of the student body, both in and out of the classroom. It shall be the responsibility of administrators and the unit member to see that all school rules and regulations are adhered to during the school day and/or when officially associated with an authorized school function. E. The Board, through the chief administrator, shall instruct the building principals and all other personnel to offer full support and cooperation in an effort to ensure compliance to all school regulations. F. In the event the regulations are being ignored by any party, such regulations shall be evaluated. If found to be sound, immediate compliance shall be stressed to all parties. However, if found to be obsolete or otherwise unsound, it shall be immediately withdrawn from operation. G. Building level discipline committees will be established in each of the District’s schools. Said committees shall consist of an administrator and one teacher from each house/team, two special teachers, and one special education teacher in grades K-8 and each department in grades 9-12 as selected by the building teaching staff. Using forms developed by the California Department of Education or as otherwise mutually agreed upon by CONTRACTOR and XXX, CONTRACTOR shall provide LEA, on a monthly basis, a written report of all incidents in which a statutory offense is committed by any LEA student, regardless if it results in a disciplinary action of suspension or expulsion. This includes all statutory offenses as described in Education Codes 48900 and 48915. CONTRACTOR shall also include, in this monthly report, incidents resulting in the use of a behavioral restraint and/or seclusion even if they were not a result of a violation of Education Code Sections 48900 and 48915. b) When NPS CONTRACTOR seeks to remove a LEA student from his/her current educational placement for disciplinary reasons, CONTRACTOR shall immediately submit a written discipline report to the LEA. Written discipline reports shall include, but not be limited to: the LEA student’s name; the time, date, and description of the misconduct; the disciplinary action taken by CONTRACTOR; and the rationale for such disciplinary action. CONTRACTOR and XXX agree to participate in a manifestation determination at an IEP/IFSP meeting no later than the tenth (10th) day of suspension. XXX shall notify and invite CONTRACTOR representatives to the IEP/IFSP team meeting where the manifestation determination will be made.

Bargaining unit members may use such reasonable physical force with a student as is necessary to protect the personal safety of themselves or staff members, visitors, or other students, or to prevent damage to district property. The District shall provide reasonable support and assistance to teachers as described in the Student Behavior Handbook so they can maintain control and discipline while engaged in their duties and responsibilities. It is essential for the school staff to establish means for obtaining the cooperation of parents of students involved in discipline problems. B. A positive disciplinary program shall be continued in each school. Each teacher shall be given a copy of the school's disciplinary policy as developed and/or modified by the principal, Instructional Council and/or faculty. C. The principal has the primary responsibility for administering the school’s disciplinary policy. In accordance with the school's disciplinary policy, the teacher is responsible for maintaining a good social environment among those students under the teacher's responsibility at any given time and for sharing with other staff members the responsibility for school-wide behavior. D. The teacher shall receive assistance from the principal when a disciplinary problem is beyond the control of the teacher or when the teacher believes it is necessary. E. The teacher may temporarily dismiss a student from class to the principal when the student's behavior is disruptive to the point of impeding learning by the other students and after efforts have been made to correct the problem in accordance with the school's disciplinary practice. 1. The teacher shall furnish the principal in writing full particulars of the incident including the efforts that have been made to correct the problem and whether or not the student may be returned to class prior to a conference between the teacher and principal. 2. Before the principal returns the student to the classroom, the principal shall inform the teacher of the corrective measures taken. 3. In cases of extreme or chronic student disruption to a classroom, the teacher may call a case conference with the principal, parents and others as necessary for the purposes of discussing the problem and determining and initiating corrective measures. If requested the student will not be returned to the classroom until such corrective measures have been initiated or until the due process rights of the student would be violated. F. Notification shall be provided to teachers of suspended students by the end of the school day that follows the day of suspension. G. Student Discipline. 18.1 The Board recognizes its responsibility to give reasonable support and assistance to teachers with respect to the maintenance of control and discipline in the classroom and on school premises. Whenever it appears that a particular student is experiencing disciplinary problems and requires the attention of professional specialists, the District will take reasonable steps to assist the teacher with responsibilities related to such student. 18.2 The parties recognize that discipline problems are less likely to occur in environments characterized by active student engagement, acceptable student behavior, efficient use of time, established routines and procedures, and consistency in handling interactions with students. The parties likewise recognize that when discipline problems occur, they may most effectively be handled through concerted efforts in understanding the source of the discipline problem and with respect for the individual student. 18.3 A teacher may refer a student to the principal or assistant principal when the seriousness of the offense, the persistence of the misbehavior, or the disruptive effect of the violation make the continued presence of the student in the classroom undesirable. In such cases, the teacher will furnish the principal, as promptly as teaching obligations allow, full particulars of the incident. A conference shall be held if the principal determines that it is appropriate. 18.4 Each teacher has disciplinary authority over any student on the school premises whether that student is assigned to the teacher or not. 18.5 Teachers recognize their responsibility to maintain a positive learning climate within their classrooms, supportive of the educational goals of the District. 18.6 Teachers may keep students after school for disciplinary reasons, but not ordinarily for more than thirty
Student Discipline. 1. Physical restraint may be used by a teacher in extraordinary cases of discipline to contain a disruptive pupil, provided the force used is reasonable. The teacher shall inform the principal at once of such an action and shall make an accurate written account of it within 24 hours, if possible. 2. The Board and the Union agree that the classroom teacher should be able to deal effectively with the normal problems of discipline in the classroom. However, when in the judgment of the teacher, a student's behavior seriously disrupts the instructional program to the detriment of the other students or creates an emergency, the classroom teacher shall have the authority to request and receive immediate assistance in classroom management, and have the student temporarily removed from the classroom by referral to the principal or his designee for behavior management intervention. The teacher may make recommendations for student discipline. If such a recommendation is made, the administration will respond in accordance with the requirements of section 1003.32, Florida Statutes. 3. Prior to readmission to the classroom, the principal or designee will communicate, preferably in writing, with the classroom teacher who referred the student. If the teacher disagrees with the principal's decision to readmit the student, he shall make is so known in writing. The principal will accept the responsibility of his decision thereof prior to the student's re-admittance. If the teacher and principal or designee mutually agree that a particular student is in need of special assistance, efforts will be made to obtain such assistance through school district procedures established for that purpose. 4. A student who physically assaults a teacher shall be immediately suspended from school. A standard procedure will be made available for all principals in reporting and investigating an assault.
