UNSUCCESSFUL OFFER. 7.1 If the Offer is not made, the Offer lapses, Bidco withdraws the Offer or it is otherwise unsuccessful, any Interest in the Target's shares which has been acquired by or on behalf of the Consortium or Bidco shall be sold and the proceeds shall be split amongst those Investors in their relevant proportions (being 50 per cent. for BCEP, and 50 per cent. for KIRKBI).

  • Notification to Unsuccessful Job Applicants The parties agree that any unsuccessful candidate for an ONA job posting will be notified, in writing, within one (1) week of the decision being made and prior to the posting of the name of the successful candidate.   • Successful Completion The percent of all Individuals receiving A&D 81 Services who successfully complete treatment must be at least [35%] (unadjusted rate). Successful completion of problem gambling treatment is defined as Individuals who have: (a) achieved at least [75%] of short-term treatment goals; (b) completed a continued wellness plan (i.e., relapse prevention plan); and (c) lack of engagement in problem gambling behaviors for at least [30] consecutive days prior to successful completion of A&D 81 Services.
