Common use of Upscaling Clause in Contracts

Upscaling. Device may scale Licensed Content in order to fill the screen of the applicable display; provided that Licensee’s marketing of the device shall not state or imply to consumers that the quality of the display of any such upscaled content is substantially similar to a higher resolution than the Licensed Content’s original source profile (i.e. SD content cannot be represented as HD content).
