Use of Adjacent Property. Except as otherwise provided herein, Approved Builder is prohibited from using any property outside the boundaries of the Lot for construction activities, including but limited to using adjacent or nearby property (e.g., Lots, Common Areas or the street) for storage of equipment, supplies, materials, dirt, or other construction related materials, for parking, or for construction staging. Notwithstanding the foregoing, however, prior to commencement of construction activities, the Approved Builder may independently negotiate a written agreement with the record owner of the adjacent lot (“Adjacent Property”) to enable the Approved Builder to use the Adjacent Property for the construction activities that would otherwise be prohibited by this Section 5. Any such written agreement must provide that neither the Association nor any Declarant shall be held liable for any claims or liabilities arising in connection with or as a result of the Approved Builder’s use of the Adjacent Property, and must include a provision wherein the Approved Builder and Owner expressly agree to hold harmless, defend, and indemnify the Association, the Declarants(s), and the respective officers, director, agents, employees, and members of each of the foregoing, from and against any and all claims or liabilities that may arise in connection with or as a result of the Approved Builder’s use of the Adjacent Property. The adjacent or nearby property will be returned to its original condition, and in the case of empty lots, debris removed, and a smooth and graveled surface reinstated. A copy of such agreement must be provided to the Association prior to the commencement of any construction activities on the Lot or on the Adjacent Property.

Use of Adjacent Property. Xxxxxx understands and agrees that the property over which Xxxxxx is allowed to wander consists of approximately 14.99 acres upon which Tenant and other Tenants’ living facilities are located.
