Other Tenants. Lessor reserves the absolute right to permit such other tenancies and businesses in the Project as Lessor, in the exercise of its sole business judgment, shall determine to best promote the interests of the Project. Lessee is not relying on the understanding, nor does Lessor represent, any specific lessee or number of lessees shall during the Term occupy any space in the Project. Lessee hereby waives all defenses arising from, and Lessor shall not be liable for damages arising from, any act or neglect of any other lessee or from Lessor’s acts or omissions in enforcing any provision of its lease against another lessee, whether or not Lessor has notice of the offending lessee’s disturbing or unlawful act or the opportunity to cure the disturbance by invoking its powers under such other lease.
Other Tenants. Landlord reserves the absolute right to effect such other tenancies in the Property as Landlord shall determine in the exercise of its sole business judgment. Tenant does not rely on the fact, nor does Landlord represent, that any specific tenant or occupant or number of tenants or occupants shall occupy any space in the Property.
Other Tenants. Tempe reserves the right to grant access, lease or sell any portion of EBVOM to other tenants, occupants or other parties and for such uses that Tempe in Tempe’s sole discretion deems appropriate. RPTA acknowledges that Tempe made no representations as to Tempe’s continued ownership of all or any portion of EVBOM or the presence of any specific tenant or number or types of tenants at EBVOM as of or after the Effective Date.
Other Tenants. Other tenants of the Project may be using, handling or storing certain Hazardous Materials in connection with such tenants' use of their premises. The failure of another tenant to comply with applicable laws and procedures could result in a release of Hazardous Materials and contamination to improvements within the Project or the soil and groundwater thereunder. In the event of such a release, the tenant responsible for the release, and not Landlord, shall be responsible for any claim, damage or expense incurred by Tenant by reason of such contamination and Tenant shall exhaust all its remedies against such other tenant without any right to seek any recovery against Landlord.
Other Tenants. Landlord reserves the right to lease any portion of the Project to such other tenants as Landlord, in Landlord's sole discretion, deems appropriate, whether or not engaged in the same or similar business for which Tenant is permitted to use the Premises under this Lease. Tenant acknowledges that Landlord has made no representation as to the presence of any specific tenant or number or types of tenants at the Project as of or after the Commencement Date.
Other Tenants. OVG shall pay City Five Hundred Thousand Dollars ($500,000) for short-term and long-term solutions developed by Seattle Center for displaced tenants other than the Skate Park and Pottery Northwest. Such amount shall be payable in two installments of Two Hundred Fifty Thousand Dollars ($250,000) each, with the first payment due within thirty (30) days after approval of this MOU by City Council and execution of same, and the second payment due within thirty (30) days of commencement of construction of the Arena.
Other Tenants. Nothing contained in this Lease shall be construed as imposing upon LANDLORD any duty or obligation to enforce such rules and regulations or the terms, conditions or covenants contained in any other lease as against any other tenant, and LANDLORD shall not be liable to TENANT for the violation of such rules or regulations or lease by any other tenant or its employees, agents, invitees, licensees, customers, clients, family members, guests or subtenants.
Other Tenants. Lessee does not rely on the fact, nor does Lessor in any way represent that any specific tenant or number of tenants shall, during the term of this Lease, occupy any space in the Project.
Other Tenants. The Tenant and its employees shall not in any way interfere with or annoy other occupants of the Building or those having business with them.
Other Tenants. Landlord shall not be liable to Tenant for failure to enforce or for violation of any Rules and Regulations or the breach of any covenant or condition in any Lease by any other tenant.
