Use of Common Elements. The Tenant has the non-exclusive right to use the Common Elements for the purposes for which they are intended, subject to this Lease.
Use of Common Elements. The Owner transfers and assigns to the lessee, for the term of the lease, any and all rights and privileges that the Owner has to use the Common Elements, including but not limited to, the use of any and all recreational facilities and other amenities.
Use of Common Elements. The Common Elements shall be used by Unit Owners and their family members, occupants, invitees and guests for such purposes incidental to the use of the Units; provided, however, areas designed for a specific use shall be used for the purposes so designated as approved by the Board. The use, maintenance and operation of the Common Elements shall not be obstructed, damaged or unreasonably interfered with by any Unit Owner.
Use of Common Elements. A Co-owner shall not place or cause to be placed in the passages or roads any furniture, packages or obstructions of any kind. Such areas shall be used for no other purpose than for normal transit through them.
Use of Common Elements. During the Term of this Lease the Tenant has the non-exclusive and non-transferable right (except in accordance with Article XII) to use the Common Elements in common with others entitled to do so, for the purposes for which they are intended and during the hours designated by the Landlord from time to time, subject however, to this Lease.
Use of Common Elements. Except the non-exclusive easements set forth in this Agreement, the Association shall have exclusive ownership and control of all Common Elements in the Association, including but not limited to the existing clubhouse and swimming pool, and the residents, occupants and/or Unit Owners of the Reserve shall have no right of access or use thereof. Developer shall fully and adequately disclose the same to all future third-party purchasers of Units developed at the Reserve. Developer shall have no right to use the existing clubhouse or swimming pool. Developer shall have exclusive ownership and control of The Reserve.
Use of Common Elements. Landlord transfers and assigns to Tenant for the term of this Lease all privileges that Landlord has to use any Association amenities. Landlord and Xxxxxx agree that delinquency by Landlord in the payment of assessments or other charges to the Association authorizes the Association to suspend Common Element use privileges. Landlord and Xxxxxx agree that the Association may notify the Tenant of any such suspension of privileges caused by the Landlord’s delinquency.
Use of Common Elements. Owner and Tenant agree that the use of the common elements is limited to either the Tenant or the Owner, but not both. Unless specifically addressed in the Lease, it will be presumed that the use of the common elements shall be by the Tenant and not the owner. If Owner becomes delinquent in the payment of the monthly regime fees owed to Woodlake, Tenant and Owner acknowledge that Woodlake may cut off access to all amenities (including, but not limited to, the fitness center, pool area, and tennis courts) to both Tenant and Owner until Owner’s account, including all late fees, fines, and other assessments, are paid in full.
Use of Common Elements. Subject to the provisions of this agreement and also subject to the rules and regulations which may be made applicable to all the Unit owners and/or as may be altered and/or modified from time to time the Common Elements shall be for common use of all the Owners and/or their tenants, lessees and other occupiers and not those which are specifically reserved for any Unit and/or Unit Owner
Use of Common Elements. The Common Elements shall be used only for purposes and in manners consistent with their design. The Common Elements shall not be used in such a manner as to unreasonably interfere with the use and enjoyment thereof by the Owners of other Units. Except within the Marina Unit or in connection with its operation, no boats or other water craft may be moored at any time to any portion the Common Elements.
