Use of interpreters. The Provider must, when carrying out the Services, provide an interpreter, in accordance with any Guidelines, to facilitate communication between the Provider and Participants wherever necessary, including where a Participant requires assistance: to communicate comfortably and effectively with the Provider, on account of language or hearing barriers; to understand complex information of a technical or legal nature; during stressful or emotional situations where their command of English may decrease temporarily; or at group forums or public consultations, where Participants do not speak or understand English, or have a hearing impairment.

The Provider must provide access to interpreter services fairly and without discrimination, based on a proper assessment of a Participant’s needs. Where a Participant requests the use of an interpreter and the Provider refuses to provide one, the Provider must record the reason for the Provider’s decision. The Provider must ensure that those of its Personnel who, when providing Services, engage with Participants who may require interpreter services, have received training in the use of interpreters in accordance with the training requirements specified in any Guidelines or as otherwise advised by the Department.

Where an Eligible Job Seeker requests the use of an interpreter and You refuse to provide one, You must record the reason for Your decision. You must meet Your own expenses for the costs of complying with this clause 18. You must ensure that those of Your personnel who, when providing Services, engage with Eligible Job Seekers who may require interpreter services, have received training in the use of interpreters in accordance with the training requirements specified in any Guidelines or as otherwise advised by Us.
