Common use of User Conduct Clause in Contracts

User Conduct. You agree not to use Synovus Gateway Mobile or the content or information delivered through the App in any way that would: (i) infringe any third-party copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy, including any rights in the App; (ii) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of the App to impersonate another person or entity; (iii) violate any law, statute, ordinance, or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, or false advertising); (iv) be false, misleading, or inaccurate; (v) create liability for us or our affiliates or service providers, or cause us to lose (in whole or in part) the services of any of our service providers; (vi) be defamatory, trade libelous, unlawfully threatening, or unlawfully harassing; (vii) potentially be perceived as illegal, offensive, or objectionable; (viii) interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway Service; (ix) interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway Service by any other user; or (x) use the App, Synovus Gateway or any Synovus Gateway Service in such a manner as to gain unauthorized entry or access to the computer systems of others.

You agree not to use Synovus Gateway Mobile Banking or the content or information delivered through the App Mobile Banking in any way that would: (i) infringe any third-party copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy, including any rights in the Appmobile application; (ii) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of the App Mobile Banking to impersonate another person or entity; (iii) violate any law, statute, ordinance, or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, or false advertising); (iv) be false, misleading, or inaccurate; (v) create liability for us or our affiliates or service providersService Providers, or cause us to lose (in whole or in part) the services of any of our service providersService Providers; (vi) be defamatory, trade libelous, unlawfully threatening, or unlawfully harassing; (vii) potentially be perceived as illegal, offensive, or objectionable; (viii) interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway ServiceMobile Banking; (ix) interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking by any other user; or (x) use the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking in such a manner as to gain unauthorized entry or access to the computer systems of others. No Commercial Use or Resale. You agree that the Mobile Banking Service is for personal use only. You agree not to resell or make commercial use of Mobile Banking.

You agree not to use Synovus Gateway Mobile Banking - MyMobile or the content or information delivered through the App Mobile Banking - MyMobile in any way that would: (ia) infringe any third-party copyright, patentpatents, trademark, trade secret, or other proprietary rights or rights of publicity or privacy, including any rights in the AppSoftware; (iib) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of the App Mobile Banking - MyMobile to impersonate another person or entity; (iiic) violate any law, statute, ordinance, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, discrimination or false advertising); (ivd) be false, misleading, misleading or inaccurate; (ve) create liability for us or our affiliates or service providers, or cause us to lose (in whole or in part) the services of any of our service providers; (vif) be defamatory, trade libelous, unlawfully threatening, threatening or unlawfully harassing; (viig) potentially be perceived as illegal, offensive, offensive or objectionable; (viiih) interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway ServiceMobile Banking - MyMobile; (ixi) interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking - MyMobile by any other user; or (xj) use the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking - MyMobile in such a manner as to gain unauthorized entry or access to the computer systems of others.

You agree not to use Synovus Gateway Mobile Banking or the content or information delivered through the App Mobile Banking in any way that would: (ia) infringe any third-party copyright, patent, trademark, trade secret, secret or other proprietary rights or rights of publicity or privacy, including any rights in the AppSoftware; (iib) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of the App Mobile Banking to impersonate another person or entity; (iiic) violate any law, statute, ordinance, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, discrimination or false advertising); (ivd) be false, misleading, misleading or inaccurate; (ve) create liability for us or our affiliates or service providers, or cause us to lose (in whole or in part) the services of any of our service providers; (vif) be defamatory, trade libelous, unlawfully threatening, threatening or unlawfully harassing; (viig) potentially be perceived as illegal, offensive, offensive or objectionable; (viiih) interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway ServiceMobile Banking; (ixi) interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking by any other user; or (xj) use the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking in such a manner as to gain unauthorized entry or access to the computer systems of others. You agree that the Service is only for the personal use of individuals authorized to access your account information. You agree not to make any commercial use of Mobile Banking or resell, lease, rent or distribute access to Mobile Banking.

You agree not to use Synovus Gateway Mobile Banking or the content or information delivered through the App Mobile Banking in any way that would: (ia) infringe any third-party copyright, patentpatents, trademark, trade secret, or other proprietary rights or rights of publicity or privacy, including any rights in the Mobile App; (iib) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of the App Mobile Banking to impersonate another person or entity; (iiic) violate any law, statute, ordinance, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, discrimination or false advertising); (ivd) be false, misleading, misleading or inaccurate; (ve) create liability for us or our the Bank and its affiliates or service providers, or cause us the Bank to lose (in whole or in part) the services of any of our the Bank’s service providers; (vif) be defamatory, trade libelous, unlawfully threatening, threatening or unlawfully harassing; (viig) potentially be perceived as illegal, offensive, offensive or objectionable; (viiih) interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway ServiceMobile Banking; (ixi) interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking by any other user; or (xj) use the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking in such a manner as to gain unauthorized entry or access to the computer systems of others.

User Conduct. You agree not to use Synovus Gateway MyOCCU Online & Mobile or the content or information delivered through the App MyOCCU Online & Mobile in any way that would: (i) : i. infringe any third-party copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy, including any rights in the App; (mobile app; ii) . be fraudulent or involve the sale of counterfeit or stolen items, including, including but not limited to, use of the App MyOCCU Online & Mobile to impersonate another person or entity; (; iii) . violate any law, statute, ordinance, ordinance or regulation (including, including but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, anti- discrimination or false advertising); (; iv) . be false, misleading, misleading or inaccurate; (v) ; v. create liability for us or our affiliates or service providers, or cause us to lose (in whole or in part) the services of any of our service providers; (; vi) . be defamatory, trade trade-libelous, unlawfully threatening, or unlawfully harassing; (; vii) . potentially be perceived as illegal, offensive, offensive or objectionable; (; viii) . interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway Service; (MyOCCU Online & Mobile; ix) . interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway Service MyOCCU Online & Mobile by any other user; or (x) or, x. use the App, Synovus Gateway or any Synovus Gateway Service MyOCCU Online & Mobile in such a manner as to gain unauthorized entry or access to the computer systems of others.

User Conduct. You agree not to use Synovus Gateway SMS Mobile Banking Service or the content or information delivered through the App SMS Mobile Banking Service in any way that would: (ia) infringe any third-party copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy, including any rights in the AppSoftware; (iib) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of the App SMS Mobile Banking Service to impersonate another person or entity; (iiic) violate any law, statute, ordinance, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, discrimination or false advertising); (ivd) be false, misleading, misleading or inaccurate; (ve) create liability for us or our affiliates or service providers, or cause us to lose (in whole or in part) the services of any of our service providers; (vif) be defamatory, trade libelous, unlawfully threatening, threatening or unlawfully harassing; (viig) potentially be perceived as illegal, offensive, offensive or objectionable; (viiih) interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway SMS Mobile Banking Service; (ixi) interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway SMS Mobile Banking Service by any other user; or (xj) use the App, Synovus Gateway or any Synovus Gateway SMS Mobile Banking Service in such a manner as to gain unauthorized entry or access to the computer systems of others.

User Conduct. You agree not to use Synovus Gateway Mobile Banking or the content or information delivered through the App Mobile Banking in any way that would: (ia) infringe any third-party copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy, including any rights in the Apprights; (iib) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of the App Mobile Banking to impersonate another person or entity; (iiic) violate any law, statute, ordinance, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, anti- discrimination or false advertising); (ivd) be false, misleading, misleading or inaccurate; (ve) create liability for us or our affiliates or service providersus, or cause us to lose (in whole or in part) the any services of any of from our service providers; (vif) be defamatory, trade libelous, unlawfully threatening, threatening or unlawfully harassing; (viig) potentially reasonably be perceived as illegal, offensive, offensive or objectionable; (viiih) interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway ServiceMobile Banking; (ixi) interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking by any other user; or (xj) use the App, Synovus Gateway or any Synovus Gateway Service in such a manner as to gain unauthorized entry or access to the computer systems or data of others. Privacy and User Information. You acknowledge that in connection with your use of Mobile Banking, Solvay Bank and its affiliates and service providers, including Fiserv, Inc. and its affiliates, may receive names, domain names, addresses, passwords, telephone and device numbers, the content of messages, data files and other data and information provided by you or from other sources in Not for Commercial Use or Re-Sale. You agree that the Mobile Banking Services are for your use as a Solvay Bank Personal Online Banking or Business Online Banking customer only. You agree not to resell or make commercial use of Mobile Banking.

You agree not to use Synovus Gateway Mobile Banking or the content or information delivered through the App Mobile Banking in any way that would: (i) infringe any third-party copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy, including any rights in the Appmobile application; (ii) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of the App Mobile Banking to impersonate another person or entity; (iii) violate any law, statute, ordinance, or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, or false advertising); (iv) be false, misleading, or inaccurate; (v) create liability for us or our affiliates or service providersService Providers, or cause us to lose (in whole or in part) the services of any of our service providersService Providers; (vi) be defamatory, trade libelous, unlawfully threatening, or unlawfully harassing; (vii) potentially be perceived as illegal, offensive, or objectionable; (viii) interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway ServiceMobile Banking; (ix) interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking by any other user; or (x) use the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking in such a manner as to gain unauthorized entry or access to the computer systems of others.

User Conduct. You agree not to use Synovus Gateway the Mobile Banking Service or the content or information delivered through the App Mobile Banking Service in any way that would: would (i) infringe any third-third party copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy, including any rights in the App; Mobile Banking Service software, (ii) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of the App Mobile Banking Service to impersonate another person or entity; , (iii) violate any law, statute, ordinance, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, discrimination or false advertising); , (iv) be false, misleading, misleading or inaccurate; , (v) create liability for us or our affiliates or service providers, or cause us to lose (in whole or in part) the services Mobile Banking Service of any of our service providers; , (vi) be defamatory, trade libelous, unlawfully threatening, threatening or unlawfully harassing; , (vii) potentially be perceived as illegal, offensive, offensive or objectionable; , (viii) interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway Mobile Banking Service; , (ix) interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway Mobile Banking Service by any other user; , or (x) use the App, Synovus Gateway or any Synovus Gateway Service result in such a manner as to gain unauthorized entry or access to the computer systems of others.

You agree not to use Synovus Gateway Mobile or the content or information delivered through the App in any way that would: (i) infringe any third-party copyright, patent, trademark, trade secret, or other proprietary rights or rights of publicity or privacy, including any rights in the App; (ii) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of the App to impersonate another person or entity; (iii) violate any law, statute, ordinance, or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discriminationantidiscrimination, or false advertising); (iv) be false, misleading, or inaccurate; (v) create liability for us or our affiliates or service providers, or cause us to lose (in whole or in part) the services of any of our service providers; (vi) be defamatory, trade libelous, unlawfully threatening, or unlawfully harassing; (vii) potentially be perceived as illegal, offensive, or objectionable; (viii) interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway Service; (ix) interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway Service by any other user; or (x) use the App, Synovus Gateway or any Synovus Gateway Service in such a manner as to gain unauthorized entry or access to the computer systems of others.

You agree not to use Synovus Gateway the Mobile Banking Service or the content or information delivered through the App Mobile Banking Service in any way that would: (ia) infringe any third-third- party copyright, patent, trademark, trade secret, secret or other proprietary rights or rights of publicity or privacy, including any rights in any software associated with the AppMobile Banking Service; (iib) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of the App Mobile Banking Service to impersonate another person or entity; (iiic) violate any law, statute, ordinance, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, discrimination or false advertising); (ivd) be false, misleading, misleading or inaccurate; (ve) create liability for us or our affiliates or service providers, or cause us to lose (in whole or in part) the services of any of our service providers; (vif) be defamatory, trade libelous, unlawfully threatening, threatening or unlawfully harassing; (viig) potentially be perceived as illegal, offensive, offensive or objectionable; (viiih) interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway Mobile Banking Service; (ixi) interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway Mobile Banking Service by any other user; or (xj) use the App, Synovus Gateway or any Synovus Gateway Mobile Banking Service in such a manner as to gain unauthorized entry or access to the computer systems of others.

You agree not to use Synovus Gateway Mobile Banking – Mobiliti or the content or information delivered through the App Mobile Banking – Mobiliti in any way that would: (i) infringe any third-party copyright, patentpatents, trademark, trade secret, or other proprietary rights or rights of publicity or privacy, including any rights in the Appsoftware; (ii) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of the App Mobile Banking – Mobiliti to impersonate another person or entity; (iii) violate any law, statute, ordinance, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination, discrimination or false advertising); (iv) be false, misleading, misleading or inaccurate; (v) create liability for us or our affiliates or service providers, or cause us to lose (in whole or in part) the services of any of our service providers; (vi) be defamatory, trade libelous, unlawfully threatening, threatening or unlawfully harassing; (vii) potentially be perceived as illegal, offensive, offensive or objectionable; (viii) interfere with or disrupt computer networks connected to the Synovus Gateway or to any Synovus Gateway ServiceMobile Banking – Mobilit; (ix) interfere with or disrupt the use of the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking – Mobiliti by any other user; or (x) use the App, Synovus Gateway or any Synovus Gateway Service Mobile Banking – Mobiliti in such a manner as to gain unauthorized entry or access to the computer systems of others.
