Value of Natural Gas. The value of Natural Gas shall be the price payable under the Approved Contract or as otherwise may be provided in the Development Plan or in this Agreement, with such fair and reasonable adjustments as required to reflect the point and type of valuation in sub- Article 8.1, or where a Contractor enters into a sale other than at arm’s-length.

Value of Natural Gas. (a) In the case of LNG exports, the value of Natural Gas at the Measurement Point shall be the arithmetic average value of the Natural Gas, calculated at the inlet flange to the LNG facility, based on the delivery price(s) or the price formulae provided in the LNG export agreement to be concluded between the ANP and the Contractor under paragraph 5.9(d), less the transport tariff by pipeline from the Measurement Point to the inlet flange to the LNG facility. (b) The value of Natural Gas shall be determined in Dollars per Mcf on a monthly basis and the value to be attributed to Natural Gas shall: (i) for arm’s length sales to third parties, be equal to the net realized price obtained for such Natural Gas at the delivery point; (ii) for sales other than at arm’s length to third parties, be determined by agreement between the ANP and the Contractor, provided, that such price or value shall reflect the following:
Value of Natural Gas. For the purposes of calculating the State’s 5% royalty share on Natural Gas, if the State elects to take its royalty on Natural Gas in cash, the value of such Natural Gas shall be the actual realised price received by the Contractor, less, transportation, compression and marketing costs.
