Vehicle Safety. Vehicles used by employees, whether or not issued to the employee, shall be maintained in safe operating condition by the state.
Vehicle Safety. Any employee who reasonably believes that a state vehicle is unsafe has an obligation to refuse to operate that vehicle and to report the reason(s) to the appropriate authority.

It shall not be a violation of this Agreement where employees refuse to operate such equipment provided such refusal is justified.

Because of the necessity and importance of safe motor vehicle conditions in the work of the police service, no motor vehicle shall be used where there is an outstanding vehicle repair slip for an item unsafe for the immediate use, signed by any command officer, until serviced by a mechanic.
Vehicle Safety. The City agrees to provide patrol vehicles which are in safe working order for assigned use by members of the Association. Requests for maintenance and repair activities shall be processed through procedures established by the Employer. All damage to patrol vehicles shall be reported promptly. Any officer who feels that a specific patrol vehicle is unsafe for duty even after corrective repairs have been completed may so indicate by filing a complaint with the division Captain. Objection shall not concern personal opinion, maintenance, or repair procedures. The City will attempt to avoid using the vehicle in question for regular duty assignments until the matter is resolved.

B. Any officer who feels that a specific patrol vehicle is unsafe for duty even after corrective repairs have been completed may so indicate by filing a complaint with the division Captain through his supervisor. Objection shall not concern personal opinion, maintenance, or repair procedures. The City will attempt to avoid using the vehicle in question for patrol duty until the matter is resolved. Patrol vehicles may be driven up to a maximum of 90,000 miles, but not less than that provided under vehicle warranty. In exigent circumstances the City has the discretion to utilize a vehicle for up to 100,000 miles, on a case-by case-basis as reviewed by and agreed by the union.
Vehicle Safety. The Transportation Provider shall ensure that drivers and Monitors (where applicable) adhere to the following:
A. If a driver should need to call their base using a cell phone, the vehicle must be stopped in a safe location to allow for safe usage (dialing, etc.). Drivers must NEVER text messagewhile they have Consumers on board.
B. No eating or drinking is allowed in the vehicle while any Consumer is in the vehicle (this also applies to the driver and Monitor).
C. The doors of the vehicle are closed and locked while the vehicle is in motion (except for the rear emergency door of vehicles which must remain unlocked in transit).
D. No fueling of the vehicle is conducted while Consumers are on board.
E. All vehicles used to transport Consumers must be smoke free and no driver or Monitor may smoke on the grounds of the Facility, Residence or Day Care Facility.
F. Only the driver shall occupy the driver’s seat.
G. Shut off the vehicle and remove the keys when not occupying the driver’s seat (not applicable for vehicles when operating hydraulic lift).
H. No pushing a vehicle with their vehicle or allowing the vehicle to be pushed while a Consumer is located in either vehicle.
I. Operate vehicles at all times in compliance with all federal, state, and local laws.
J. No personal stops while transporting HST Consumers, unless specifically authorized.
K. No headphones (including Bluetooth or any other type of wireless phone headset) while on duty; and
L. No firearms, alcoholic beverages, unauthorized controlled substances, or highly combustible materials (other than oxygen tanks required by Consumers) shall be transported in the vehicle.

Vehicle Safety. The City shall provide safe vehicles for use by City EMPLOYEES, whenever an EMPLOYEE'S duties require operation of a motor vehicle. All necessary repairs and maintenance of vehicles shall be performed to insure the safety of the operator. Under no circumstances shall a supervisor of the City require an EMPLOYEE to operate an unsafe vehicle. Routine maintenance of City vehicles shall be no less than recommended by the manufacturer. Only high quality parts and tires will be used on City vehicles. EMPLOYEES shall not be required to use their own vehicles for City business.
