Vehicle Terms of Use and Maintenance. 4.1 The use of the vehicle is permitted to the Subscriber only according to the terms of this contract. 4.2 Instructions regarding the supply of the Subscription Card to the Subscriber and any Additional Driver under the subscription will be emailed and / or sent by text message after completion of the registration in the system of the Subscriber / the Additional Driver. 4.3 The right to use the vehicle is exclusive to the Subscriber and cannot be transferred. In addition, the use of the Subscription smartcard is intended for the cardholder only. 4.4 Prior to using the vehicle, and as a condition of using the vehicle, the Subscriber shall perform an inspection of the vehicle according to the inspection form attached to this contract as Appendix A. Afterwards, the Subscriber shall sign a declaration stating that the Subscriber has inspected the vehicle prior to receiving it and found that the state of the vehicle is satisfactory and that there is no damage, and that he or she shall return the vehicle in the same state that he or she received it, with the exception of normal wear that comes from reasonable use of the vehicle, according to the wording that can be found as well in appendix A. In the event that the Subscriber finds damage to the vehicle, he or she must report said damage to the Company prior to using the vehicle, otherwise the damage shall be attributed to whoever declared that the state of the vehicle was acceptable and free of damage. 4.5 The Subscriber must immediately inform the Company regarding any damage, internal or external to the vehicle, which is found and/or caused during the use of the vehicle. 4.6 For any damage that is found after the vehicle is returned and without prior notice, the last subscriber who used the vehicle will be held liable for the said damage. Having said that, if the subscriber uploads photos of the vehicle through the app at the end of the car rental, and this report shows that no damage was caused by him/her, the subscriber will not be held liable. 4.7 It is absolutely forbidden to use the vehicle in the following manners: (1) On unpaved roads or roads that are unsuitable for safe driving such as scraped roads, roads with potholes, etc. For transporting passengers for pay and for transporting goods for pay. (2) For racing and/or speed tests and/or any other competitive sport. (3) For towing or pushing another vehicle. (4) For transporting explosive materials. (5) For transporting more passengers than are permitted according to the vehicle’s license. (6) When the Subscriber is under the influence of drugs and/or alcohol and/or medications that might affect his/her level of consciousness. (7) When the Subscriber has a medical condition or disability that prevents him or her from holding a drivers license or from operating a vehicle. (8) For illegal purposes. (9) For transporting animals and/or putting animals in the vehicle for any other reason. (10) For placing items on the vehicle without the appropriate equipment. 4.8 The use of the vehicle is permitted only within the State of Israel and therefore it is not permitted to use this vehicle: (1) Outside of the territory of the State of Israel, (2) In areas controlled by the Palestinian Authority, (3) Beyond the Green Line, with the exception of the Golan Heights. 4.9 The operation of the vehicle shall be conducted according to the provisions of this contract, including its appendices and the User Guide. 4.10 Filling the gas tank: 4.9.1 The gas tank shall be filled only with the gas type designated in the vehicle manual. 4.9.2 The gas tank shall be filled as follows: (1) The vehicle shall have at least a quarter tank of gas at all times. (2) When the quantity of gas in the tank approaches a quarter of a tank, the Subscriber shall fill the gas tank in the car completely. (3) Returning the vehicle to the Company with less than a quarter of a tank of gas shall result in a fine as detailed in the User Guide. 4.11 Whenever the vehicle is not in use by the Subscriber, the vehicle must remain locked.
