Common use of Vehicle Unavailability Clause in Contracts

Vehicle Unavailability. Whenever, as the result of the unavailability of appropriate District vehicles due to mechanical or other malfunctions, a bus driver regularly scheduled to work is unable to work, he/she will receive pay at the rate he/she would have received for working that day provided the employee reports to the immediate supervisor for work and is assigned alternate duties to be performed in lieu of his/her primary duty.

Whenever, as the result of the unavailability of appropriate District Agency vehicles for which they are licensed to drive due to mechanical or other malfunctionsmalfunctions or any other reason, a bus driver regularly scheduled to work is unable to work, he/she will shall receive pay at the rate he/she would have received for working that day provided the employee reports to the immediate supervisor for work and is assigned alternate duties to be performed in lieu of his/her primary dutyday.
