Voluntary and Knowing Agreement. You represent that you have thoroughly read and considered all aspects of this agreement, that you understand all its provisions and that you are voluntarily entering into this agreement.

Each Party hereby warrants and represents that: ● It is competent, as a matter of law, to enter into this Agreement; ● It has been advised and encouraged in writing by the other Party to consult with an attorney before signing this Agreement; ● It has consulted with an attorney before signing this Agreement; ● It has relied on its own judgment and that of its counsel regarding the consideration for and language of this Agreement; ● The signatories have been authorized, as necessary, to execute this Agreement; ● It understands this document and has obtained answers to questions which it has raised about the document; and, ● No statements made by any other Party have in any way coerced or influenced it to execute this Agreement.

Voluntary and Knowing Agreement. Xxxxxx acknowledges and agrees that he has, at all times in connection with the negotiation, preparation, review and revision of this Agreement, been represented by a representative of his own choosing and been afforded a reasonable period of time to review this Agreement and its terms and to have it explained to him by his representative, that he has read and understands this Agreement, that he is fully aware of its contents and of its legal effect, that the preceding paragraphs represent the full consideration for this Agreement, and that he enters into this Agreement voluntarily and without coercion based on his own judgment, and not in reliance upon any representations or promises made by any other party, except those contained in this Agreement.

Voluntary and Knowing Agreement. The Class Agent represents that she is of legal age and mentally competent to execute this Settlement Agreement. The Class Agent acknowledges that she has had an opportunity to consult with Class Counsel regarding the provisions of this Settlement Agreement. The Class Agent acknowledges that she has carefully read and fully understands and agrees to all provisions of this Settlement Agreement prior to signing it. The Class Agent further acknowledges that she has entered into this Settlement Agreement freely, knowingly, voluntarily and without coercion, threat or duress and that the Settlement Agreement is final and binding.
