Voluntary Settlement. The Parties agree that this Settlement Agreement was negotiated in good faith by the Parties, and reflects a settlement that was reached voluntarily after consultation with competent counsel and the participation of a neutral mediator, and no Party has entered this Settlement Agreement as the result of any coercion or duress.
Voluntary Settlement. The Settling Parties agree that the Settlement Amount and the other terms of the Settlement as described herein were negotiated in good faith by the Settling Parties, and reflect a settlement that was reached voluntarily after consultation with competent legal counsel.
Voluntary Settlement. This Settlement Agreement was negotiated in good faith and at arm’s-length over several weeks, and the exchange of the Remediation Payment and Litigation Costs Payment for the releases set forth herein is agreed to represent appropriate and fair consideration.
Voluntary Settlement. Each Party hereto enters into the settlement, this Settlement Agreement and the documents referred to herein, knowingly and voluntarily, in the total absence of any fraud, mistake, duress, coercion, or undue influence and after careful thought and reflection upon the settlement, this Settlement Agreement and the documents referred to herein; and accordingly, by signing this document and the documents referred to herein, each signifies full understanding, agreement and acceptance.
Voluntary Settlement. The Employee/Claimant understands that he, like the Employer/Carrier/Servicing Agent, does not have to settle and is doing so freely, voluntarily and with no duress or coercion from anyone. The Employee/Xxxxxxxx also affirms that he is mentally competent and understands all of the terms of this agreement and the consequences therefrom and further has had advice of counsel, with whom the Employee/Claimant is satisfied. The Employee/Claimant further understands that he has the right to take any claim/petition for any Workers’ Compensation benefits to a hearing to have said claim/petition heard by a Judge of Compensation Claims and that by settling he gives up that right permanently. The Employee/Claimant represents that he has read this settlement agreement and release and hereby acknowledges that he understands and accepts all of the terms and conditions herein and that he has done so with the advice of counsel.
Voluntary Settlement. Each Party represents (a) that it has read, and been advised by counsel regarding this Agreement, (b) that it understands this Agreement’s provisions and legal effect, and (c) that it is voluntarily entering into this Agreement of its own accord and without duress or coercion by any other party. Each Party further represents that, in executing this Agreement, it does not rely on any inducements, promises or representations by any other party other than those expressly set forth in this Agreement.
Voluntary Settlement. The parties to this Agreement acknowledge and agree that each of them is entering into this Agreement freely and voluntarily and not acting under any misapprehension as to the effect hereof, and has acted and does hereby act freely and voluntarily and not under any coercion or duress, and acknowledge that good and valuable consideration was and has been received. The parties hereto declare that this Agreement is freely and fairly made and that, except as specifically referenced in this Agreement, there are no other agreements, oral or written or otherwise, pertaining to the subject matter of this Agreement.
Voluntary Settlement. The Parties acknowledge and agree that each of them is entering into this Release Agreement freely and voluntarily and not acting under any misapprehension as to the effect hereof, and has acted and does hereby act freely and voluntarily and not under any coercion or duress.
Voluntary Settlement. At any time after a dispute has arisen, any of the Owners may deliver written notice to any other Owner describing the dispute in reasonable detail and invoking the voluntary settlement procedures of this Section 10.1.1. The Owners shall meet and negotiate in good faith in an effort to resolve the dispute by mutual agreement for a period of thirty (30) days after receipt of such notice, as such period may be extended by mutual agreement of the Owners.
Voluntary Settlement. By entering into this Agreement, the Parties represent that they each have been represented by counsel at all relevant time-periods, have had a chance to seek and obtain the advice of counsel, have read the Agreement, understand the terms of the Agreement, and are voluntarily entering into this Agreement.
