Within 14 days after Defendants funds the Gross Settlement Amount, the Administrator will mail checks for all Individual Settlement Payments, the Administration Expenses, the LWDA Payment, Attorneys’ Fees, Litigation Costs, and Service Payment(s).
If the Court approves Attorneys’ Fees and/or Litigation Costs in an amount less than the amounts requested, the Administrator will allocate the remainder to the Net Settlement Amount.
At the Final Approval Hearing, the Class Representative, through Class Counsel, will ask the Court to approve a Gross Settlement Amount of $300,000 and authorize the following deductions: Service Payment ($10,000), Attorneys’ Fees in the amount of 33.33% of the Gross Settlement, Litigation Costs (not to exceed $25,000), the LWDA’s 75% portion of the PAGA Payment, and the Administration Expenses to be paid to the third-party settlement administrator.
The Administrator will pay the Attorneys’ Fees and Litigation Costs using one or more IRS 1099 Forms.
Class Counsel assumes full responsibility and liability for taxes owed on the Attorneys’ Fees and Litigation Costs and holds Defendants harmless, and indemnifies Defendants, from any dispute or controversy regarding any division or sharing of any of these payments.
