Waiver of Distraint. Landlord hereby waives and relinquishes any and all rights or remedies against Tenant pursuant to any lien, statutory or otherwise that it may have against the property, goods or chattels of Tenant in or on the Premises. The rights and remedies under this Lease are cumulative, and either party’s using any one right or remedy will not preclude or waive that party’s right to use any other. These rights and remedies are in addition to any other rights the parties may have by law, statute, ordinance, or otherwise.
Waiver of Distraint. 46.1 Landlord hereby expressly waives any and all rights granted by or under any present or future laws to levy or distrain for rent, in arrears, in advance or both, on any goods, merchandise, equipment, fixtures (which Landlord and Tenant agree are Tenant's Property), furniture or other personal property of the Tenant (collectively defined for this Article only as "Tenant's Property"), or any subtenant or licensee of Tenant except after Landlord has instituted a legal action which permits the Landlord to levy or distrain on Tenant's Property.

Waiver of Distraint. Landlord waives all lien, right, interest and claim it might otherwise have in and waives its right of distraint of, the machinery, fixtures and other property of the Tenant, and in any other property of any nature whether on or off the Premises, belonging to the Tenant. The provisions of this Paragraph are intended to apply to the Landlord's common law (if any) and statutory right of distraint because of failure to pay Fixed Rent or Additional Rent.

Landlord hereby expressly subordinates in favor of Tenant's equipment lessor or owner/secured party any and all rights granted by or under any present or future laws to levy to distrain for rent, in arrears, in advance or both, upon any pylon signs, other signs, movable trade fixtures, equipment, furniture or other personal property installed by Tenant, leased or financed by Tenant from the equipment lessor or owner/secured party and delivered or to be delivered to the Demised Premises.

Waiver of Distraint. The Issuer waives any statutory or common law right it may have to distrain upon or place a lien against any equipment, machinery, furniture or other personal property now or hereafter located on or in the Project Facilities which is owned by any party other than the Company.
