Waiver of Exemption. Any constitutional or statutory exemption of Lessee of any property usually kept on the Leased Premises, from distress or forced sale, is waived.

Waiver of Exemption from Distress --------------------------------- The Tenant hereby agrees with the Landlord that, notwithstanding anything contained in section 30 of the Landlord and Tenant Act (Ontario) (the "Act")or any Statute subsequently passed to take the place of or amend the Act, none of the goods and chattels of the Tenant at any time during the continuance of the Term on the Premises shall be exempt from levy by distress for rent or Additional Rent in arrears by the Tenant as provided for by any Sections of the Act or any amendments thereto, and that if any claim is made for such exemption by the Tenant or if a distress is made by the Landlord, this covenant and agreement may be pleaded as an estoppel against the Tenant in any action brought to test the right to the levying upon any such goods as are named as exempted in any sections of the Act or amendments thereto; the Tenant waiving, as it hereby does, all and every benefit that could or might have accrued to the Tenant under and by virtue of any sections of the Act or any amendments thereto but for this covenant.

Borrower waives all rights of exemption pertaining to real or personal property as to any indebtedness secured by or that may be secured by this Mortgage, and Borrower waives the benefit of any statute regulating the obtaining of a deficiency judgment or requiring that the value of the Mortgaged Property be set off against any part of the indebtedness secured hereby.
Waiver of Exemption. The Borrower hereby shall not waive its exemption right or the exemption right of its assets in any judicial district in any lawsuit or judicial process through cancellation.
