Waiver of Your Rights. YOU EXPRESSLY UNDERSTAND AND AGREE THAT BY EXECUTING YOUR ORDER FORM AND RECEIVING SERVICES FROM ASTOUND, YOU ARE AGREEING TO THE PROVISIONS OF THIS SECTION 14 WHICH REQUIRE THAT ANY DISPUTES BETWEEN YOU AND ASTOUND BE RESOLVED BY BINDING ARBITRATION AND NOT BY GOING TO COURT BEFORE A JUDGE AND/OR A JURY. YOU KNOWINGLY AND IRREVOCABLY WAIVE, TO THE FULLEST EXTENT PERMITTED BY LAW, YOUR STATUTORY AND CONSTITUTIONAL RIGHT TO TRIAL BEFORE A JUDGE AND/OR A JURY OF ANY DISPUTES, CLAIMS OR ISSUES ARISING OUT OF OR RELATING TO YOUR AGREEMENT AND THE SERVICES PROVIDED TO YOU BY ASTOUND.

Waiver of Your Rights. If You fail to refer any dispute, controversy or difference to arbitration within twelve (12) months from the expiry of the negotiation period specified at the clause titled “Arbitration” under this Part 4, You shall be deemed to have accepted Our position in respect of the dispute, controversy or difference and to have waived all Your rights or claims with respect to the same.
Waiver of Your Rights. To the extent permitted by Law, the Loan Parties waive all rights of exemption in the Goods under the Laws of this or any other state; notice of the acceptance of the Guaranty; and demand, presentment, notice of dishonor, protest, and suit.

  • Waiver of Breach The waiver by either party of a breach of any provision of this Agreement shall not operate or be construed as a waiver of any subsequent breach thereof.

Neither the State’s review, approval or acceptance of, nor payment for, the services required under this Contract shall be construed to operate as a waiver of any rights under this Contract or of any cause of action arising out of the performance of this Contract, and the Contractor shall be and remain liable to the State in accordance with applicable law for all damages to the State caused by the Contractor’s negligent performance of any of the services furnished under this Contract.
