Common use of Warranties for Maintenance Services Clause in Contracts

Warranties for Maintenance Services. 9.1 Warranties for Maintenance Services (a) all Maintenance Services furnished pursuant to the CMA Documents shall conform to Good Industry Practice; (b) the Maintenance Services shall be free of Defects, including design Errors, except to the extent such Defects are inherent in prescriptive specifications included in the CMA Documents; (c) materials and equipment installed or incorporated under the CMA Documents shall be of good quality and new; (d) all design and construction work performed under the CMA Documents shall be fit for use for the intended function; and (e) such Maintenance Services shall meet all of the requirements of the CMA Documents. The warranties set forth in clauses (a)-(e) above shall individually be referred to herein as a “Warranty” and, collectively, as the “Warranties.”
