Common use of Warranties for Maintenance Services Clause in Contracts

Warranties for Maintenance Services. Maintenance Contractor warrants that: (a) all Maintenance Services furnished pursuant to the COMA Documents shall conform to Good Industry Practice; (b) the Maintenance Services shall be free of Defects, including design Errors, except to the extent such Defects are inherent in prescriptive specifications included in the Maintenance Documents; (c) materials and equipment installed or incorporated under the COMA Documents shall be of good quality and new; (d) all design and construction work performed under the COMA Documents shall be fit for use for the intended function; and (e) such Maintenance Services shall meet all of the requirements of the COMA Documents. The warranties set forth in clauses (a)-(e) above shall individually be referred to herein as a “Warranty” and, collectively, as the “Warranties.”
