Weekly Indemnity. The Employer shall implement a twenty-six (26) week plan providing seventy-five percent (75%) of an employee’s normal wages, paid as follows: (1) on the first (1st) day of hospitalization due to non-occupational accident or sickness, or (2) on the fourth (4th) day of absence due to non-occupational accident or sickness Benefit cheques for Weekly Indemnity shall, upon written request of the employee, be mailed to their home address. Where an employee submits a claim to the Workers’ Compensation Board which may, were it not for the existence of Workers’ Compensation, entitle the employee to Weekly Indemnity benefits under this section and such claim is disputed or delayed by the Workers’ Compensation Board, the employee may submit a claim for Weekly Indemnity benefits. For the purpose of this provision “delayed” shall be defined as the failure to accept the employee’s Workers’ Compensation Board claim with seven (7) days of it having been filed. If the Workers’ Compensation Board later accepts responsibility for the payment of such disputed or delayed claim, then Weekly Indemnity benefits received are to be reimbursed to the Insurance Carrier upon receipt of payment from Workers’ Compensation Board. Where an employee applies for Weekly Indemnity benefits, and the Weekly Indemnity carrier has not made a determination as to whether the employee’s claim will be accepted within ten (10) days of the application, the employee shall be entitled, upon request, to an advance of any portion of his or her unused vacation pay.

Weekly Indemnity. (h) Where there has been a delay in the payment of Worker’s Compensation Benefits, upon requestemployees will be advanced payment under the terms of the Weekly Indemnity Plan, subject to the following: i) The employee has completed all the necessary forms. ii) There has been a delay of two (2) weeks or more since the benefits became payable. iii) The employee will authorize, in writing, repayment by the Worker’s Compensation Board directly to the Weekly Indemnity Plan, when Worker’s Compensation Benefits become available. iv) In the event that the Worker’s Compensation claim has been denied, and the terms and conditions of the Weekly Indemnity Plan have not been met, the employee will repay all amounts previously advanced. v) It is not intended that an advance employee receive wage loss payment from more than one source for the same period which exceeds one hundred percent (100%) of any normal wages. It is understood that in those situations, the insurance carrier may recover amounts in excess of one hundred percent (100%) in accordance with the subrogation provisions of the plan. (i) All eligible employees will be covered with group life and AD&D insurance for forty thousand dollars ($40,000). New employees have a ninety (90) working day period before becoming eligible to join the plan. The full cost of this coverage is to be paid for by the Company. (j) M.S.P. (Medical Services Plan of British Columbia) coverage is provided for all eligible employees. New employees have a ninety (90) working day waiting period before becoming eligible for this benefit. (k) The Company shall continue to pay its portion of his the premiums for M.S.P., Extended Health, dental, life insurance and other insured benefits for eligible employees on extended disability, W.C.B. or her unused vacation paysick leave for a maximum of three (3) years from the date the absence from work commenced. Each employee shall be required to provide adequate evidence of such disability or sickness.
