Common use of Welfare Plan Funding Clause in Contracts

Welfare Plan Funding. With respect to each Welfare Plan, all claims incurred by Employees thereunder for which either Company is, or will become, liable are (i) insured pursuant to a contract of insurance whereby the insurance company bears any risk of loss with respect to such claims; (ii) covered under a contract with a health maintenance organization (an "HMO") pursuant to which the HMO bears the liability for such claims, or (iii) reflected as a liability or accrued for on either Company's balance sheet.

Welfare Plan Funding. With respect to each Welfare Plan, all claims incurred (including claims incurred but not reported) by Employees thereunder for which either the Company is, or will become, liable are (iX) insured pursuant to a contract of insurance whereby the insurance company bears any risk of loss with respect to such claims; (iiY) covered under a contract with a health maintenance organization (an "HMO") pursuant to which the HMO bears the liability for such claims, or (iiiZ) reflected as a liability or accrued for on either the Books and Records of the Company's balance sheet.

With respect to each Welfare PlanPlan applicable to employees located in the United States, all claims incurred (including claims incurred but not reported) by Employees employees thereunder for which either the Company is, or will become, liable are (iA) insured pursuant to a contract of insurance whereby the insurance company bears any risk of loss with respect to such claims; (iiB) covered under a contract with a health maintenance organization (an "HMO") pursuant to which the HMO bears the liability Liability for such claims, or (iiiC) reflected as a liability or accrued for on either Company's balance sheetthe Company Financial Statements.

With Except as disclosed in Schedule 2.11(a), with respect to each Welfare Plan, all claims incurred (including claims incurred but not reported) by Employees thereunder for which either the Company is, or will become, liable are (i) insured pursuant to a contract of insurance whereby the insurance company bears any risk of loss with respect to such claims; or (ii) covered under a contract with a health maintenance organization (an "HMO") pursuant to which the HMO bears the liability for such claims, or (iii) reflected as a liability or accrued for on either Company's balance sheet.
