Health and Welfare Fund. Pursuant to provisions contained in a pre vious Collective Bargaining Agreement, there has been established a Health and Welfare Fund known as the “ Retail Meat Cutter Unions and Employers Joint Health and Welfare Fund For The Chicago Area” ; said Fund is hereinafter referred to as the “ Health and Welfare Fund.”
Health and Welfare Fund. 1. The Employer and the Association agree to establish a Health and Welfare Fund or Funds which shall be jointly administered by an equal number of trustee members. The Trustees' task, among other things, will be the selection of any additional benefits or the increasing of existing benefits dependent upon the size of the fund.
2. Effective the first pay period of January 2015, the Employer agrees to contribute to the Health and Welfare Fund at the rate of fifteen and a half dollars ($15.50) each calendar week for each full-time equivalent bargaining unit member.
3. No dispute over a claim for any benefits extended by this Health and Welfare Fund shall be subject to Article X -
Health and Welfare Fund. The Employer agrees to contribute the amount set forth under Appendix A, for each hour worked by each employee covered by this agreement into a general fund hereinafter known as the “Indiana State Plasterers and Cement Masons Health and Welfare Fund”.
Health and Welfare Fund. (a) Employers bound by this Agreement shall pay the amount indicated in the wage schedule for all hours worked by employees engaged in the insulation trade into a jointly administered Health and Welfare Fund. Contributions shall be remitted not later than the fifteenth (15th) day of the following month to the Asbestos Workers Insurance Benefit Trust Fund, 00000 - 000 Xxxxxx, Xxxxxxxx, Xxxxxxx, X0X 0X0.
(b) Employers bound by this Collective Agreement shall also be bound by the Trust Agreement, and any amendments to the Trust Agreement, which has established the Asbestos Workers' Insurance Benefit Trust Fund of Alberta. The Employers shall not, however, be bound to any amendment to the Trust Agreement which has the effect of making the Employers, or any individual Employer, liable to the Trust Fund for an amount greater than the contributions which the Employer is required by this Collective Agreement to remit to the Fund, together with any reasonable liquidated damages, legal fees and disbursements which the Employer may be required to pay by reason of the Employer not remitting such contributions to the Trust Fund as are required by this Collective Agreement.
(1) the Employer has contributed for the period covered by such inspections or audit less than the amount which such Employer should have contributed under this Collective Agreement (the "Agreed Amount") by an amount equaling or exceeding five (5%) percent of the Agreed Amount;
(2) the cost and expense incurred by the Trust Fund are reasonable and are attributable solely to the audit or inspection;
(3) respecting circumstances in which there is a difference between the Employer and the Union and / or the Trustees of the Trust Fund and / or others as to whether certain work is affected by Registration Certificate No. 9 and this Collective Agreement, the C.L.R. Insulators (Provincial) Trade Division Negotiating Committee concurs with the Trustees of the Trust Fund that it is reasonable and appropriate to require the Employer to pay those costs and expenses; and
(4) the Trustees of the Trust Fund have considered all of the circumstances under which the Employer has failed to pay the Agreed Amount by an amount equaling or exceeding five (5%) percent of the Agreed Amount, and the Trustees after considering all of the circumstances are satisfied that it is reasonable and appropriate to require the Employer to pay those costs and expenses. Health and Welfare Fund. Section 12.01 The Employer agrees to pay into a Welfare Fund, known the Line Construction Benefit Fund, Six Dollars and seventy five cents($6.75) for each hour worked by all employees covered by this Agreement. The contributions of the Employer shall be used to provide temporary disability insurance, hospital, surgical and medical expense benefits to eligible employees and/or their dependents in such form and amount as the trustees of the Welfare Fund may determine and to provide funds for the organization and administration expenses of the Welfare Fund. The
Section 12.02 The said Welfare Fund shall be administered pursuant to an Agreement and Declaration of Trust administered jointly by representatives of the Chapter and the Local Unions. If any Employer fails to make contributions to said Welfare Fund as provided in this Agreement no later than the 20th day following the end of each calendar month, he shall be subject to having this Agreement terminated upon seventy-two hours notice in writing being served by the Union; provided the individual Employer fails to show satisfactory proof that the required payments have been paid to the Line Construction Benefit Fund.
Section 12.03 The Employer agrees to pay into a Benefit Fund, known as the Line Construction Health Reimbursement Account (HRA), an amount equal to twenty-five cents ($0.25) for all hours worked, for all employees covered by this Agreement.
Section 12.04 It is agreed that in accord with the IBEW District Ten NECA Individual Equity Retirement Plan Agreement entered into between the National Electrical Contractors Association, Inc., and the International Brotherhood of Electrical Workers on December 11, 1973, as amended, and now delineated as the National Electrical Annuity Plan Agreement and Trust, that unless authorized otherwise by the National Electrical Annuity Plan ("NEAP"), the individual employer will forward monthly to NEAP’s designated collection agent an amount equal to twenty- five percent (25%) of the gross monthly labor payroll, together with a completed payroll report prescribed by the NEAP. The payment shall be made by check or draft and shall constitute a debt due and owing to NEAP on the last day of each calendar month, which may be recovered by suit initiated by NEAP or its assignee. The payment and the payroll report shall be mailed to reach NEAP not later than fifteen (15) calendar days following the end of each calendar month.
Health and Welfare Fund. The DGC shall operate and administer a Health and Welfare Fund for the purpose of providing health and welfare benefits to eligible members of the Union on a schedule to be determined by the DGC. The Employer shall contribute to the DGC Health and Welfare Fund a sum equal to four percent (4%) of the Gross Wages of each Employee covered hereby. The four percent (4%) contribution rate shall be supplemented by twelve dollars ($12.00) per day. Payment shall be made by cheque payable to the “Directors Guild of Canada - Health and Welfare Plan” on or before the fourth day of the succeeding work week and shall be remitted for purposes of collection and transmittal through the Union office. It is recognized and agreed that Health and Welfare contributions are not subject to the GST.
Health and Welfare Fund. The Employer shall contribute to xxx Xxxxxxxxxx' Insurance Benefit Trust Fund of Saskatchewan at the rate established in the respective wage schedule per hour for each hour of work performed by each of its Employees covered by this Agreement. Such contributions shall be remitted to such place or places as designated by the Trustees of said Fund and be made by the fifteenth (15th) of the month following the month for which such contributions are payable.
Health and Welfare Fund. 23.01 The Employer agrees to contribute an amount equivalent to one percent (1%) earned (gross) by all employees each month to the Union’s designated Health & Welfare Fund.
Health and Welfare Fund. The Employer and the Union agree to establish a Health and Welfare Fund. The board of trustees of the Health and Welfare Fund, composed of an equal number of representatives of the Employer and the Union, shall determine in their discretion and within the terms of this Agreement and the Agreement and Declaration of Trust such health and welfare benefits to be extended by the Health and Welfare Fund to bargaining unit members and/or their dependents.
(1) Effective April 13, 2008, the Employer agrees to contribute to the Health and Welfare fund on behalf of each full-time equivalent state-funded bargaining unit member the sum of thirteen dollars ($13) each calendar week. Effective at the beginning of the first pay period in January 2011, the Employer agrees to contribute to the Health and Welfare fund on behalf of each full-time equivalent state-funded bargaining unit member the sum of thirteen dollars and fifty cents ($13.50) each calendar week. Effective at the beginning of the first pay period in January 2012, the Employer agrees to contribute to the Health and Welfare fund on behalf of each full-time equivalent state- funded bargaining unit member the sum of fourteen dollars ($14) each calendar week. The contributions made by the Employer to the Health and Welfare Fund shall not be used for any purpose other than to provide health and welfare benefits and to pay the operating and administering expenses of the fund. The contributions for state-funded bargaining unit members shall be made by the Employer in an aggregate sum within forty-five (45) days following the end of the calendar month during which contributions were calculated.
(2) Effective April 13, 2008, the Employer agrees to contribute to the Health and Welfare fund on behalf of each full-time equivalent non-state-funded bargaining unit member except those employed by the Division of Continuing Education the sum of thirteen dollars ($13) each calendar week. Effective at the beginning of the first pay period in January 2011, the Employer agrees to contribute to the Health and Welfare fund on behalf of each full-time equivalent non-state-funded bargaining unit member except those employed by the Division of Continuing Education the sum of thirteen dollars and fifty cents ($13.50) each calendar week. Health and Welfare Fund. The employer agrees to contribute the amount set forth under Article VII Wage Rates -Section 1 Health & Welfare for each hour worked into the Indiana State Plasterers and Cement Masons Health & Welfare Fund.
(A) If a National Health Care System becomes mandated to employers and participants of the Union Health & Welfare Fund in some way causing the plan to become obsolete or unlawful, the parties of this Agreement will negotiate how the contributions referenced in Article V will be redistributed within the Agreement or elsewhere.
