Where Transnet refers a dispute and the Concessionaire considers it to be an Associated Contract Dispute, the Concessionaire shall timeously notify the appropriate Associated Party (ies) of the Associated Contract Dispute within a reasonable time prior to any proceedings contemplated by the Concessionaire and Transnet, which notice shall be given in terms of clause 16 (Notices and Domicialia) of this Agreement.

Where Transnet. Freight Rail requires scheduled maintenance, it will notify XXXX at least ten 10 (ten) working days in advance of such scheduled maintenance. XXXX acknowledges that such maintenance may result in planned transport being delayed or rescheduled. Each instance of scheduled maintenance (“scheduled occupation”) shall not be longer than 10 (ten) days and Transnet Freight Rail may require up to 3 (three) scheduled occupations per annum.
Where Transnet. Freight Rail provides accommodation with reasonable facilities, it must be utilised and expenses are payable in terms of the South African Revenue Service regulations, as amended from time to time, as pet sub-clause 9.3.6.3 and as per Transnet Travel & Subsistence Policy and/or any relevant collective agreement.
