WITHDRAWAL OF PROPOSAL. 26.1. No proposal may be withdrawn for a period of 180 calendar days after the scheduled time for receiving proposals. A proposal may be withdrawn prior to the proposal opening date and time. Xxxxxxxxxx requests must be made in writing to the Procurement Management Director, who will approve or disapprove the request. 26.2. A proposer may withdraw a proposal any time prior to the opening of the solicitation. 26.3. After proposals are opened, but prior to award of the contract by the County Commission, the Procurement Management Director may allow the withdrawal of a proposal because of the mistake of the proposer in the preparation of the proposal document. In such circumstance, the decision of the Procurement Management Director to allow the proposal withdrawal, although discretionary, shall be based upon a finding that the proposer, by clear and convincing evidence, has met each of the following four tests: 26.3.1. The proposer acted in good faith in submitting the proposal, 26.3.2. The mistake in proposal preparation that was of such magnitude that to enforce compliance by the proposer would cause a severe hardship on the proposer, 26.3.3. The mistake was not the result of gross negligence or willful inattention by the proposer; and 26.3.4. The mistake was discovered and was communicated to the County prior to the County Commission having formally awarded the contract/agreement.
