Common use of WORK LIMITATIONS Clause in Contracts

WORK LIMITATIONS. 13.1 No employee in the bargaining unit whether working or on layoff will be laid off work by reason of any person outside the bargaining unit performing any work which is normally performed by employees in the bargaining unit providing the equipment and work are available. The Employer agrees to discuss with the Union Chairperson or designate the outsourcing of work normally performed by bargaining unit employees as far in advance of the outsourcing as possible in order to consider options for maintaining such work in-house. 13.2 Salaried employees, not subject to the provisions of this Agreement, shall not perform work normally performed by members of the bargaining unit except that they may perform such work in the following situations: 1) in emergencies arising out of unforeseen circumstances which call for immediate action to avoid interruptions of operations, and 2) in the instruction or training of employees including demonstrating the proper method to accomplish the task assigned, and 3) in the performance of work of an experimental nature.
