Common use of WORKMANSHIP AND MATERIALS Clause in Contracts

WORKMANSHIP AND MATERIALS. 1.12.1 Contractor shall furnish all supervision, labor, transportation, materials, tools and equipment necessary to satisfactorily complete the service in a manner consistent with the Project Manager’s plan and schedule. Contractor’s equipment shall be of the size and type appropriate for completing the various types of work described in this RFP. Contractor shall ensure that any equipment considered by the Project Manager to be improper or inadequate for this purpose is removed from the site and replaced with satisfactory equipment. 1.12.2 All work performed under this contract shall be completed in accordance with local, state, and national codes and standards, and other recognized industry standards associated with the work. 1.12.3 Contractor and their employees shall be certified by the VDH Asbestos and Lead Regulatory Program. For mold remediation work, Contractor shall be certified by the American Council of Accredited Certifications or equivalent certification body. 1.12.4 Lead or asbestos abatement work performed under this contract shall be in accordance with the regulations of the VDH Asbestos and Lead Regulatory Program, United States Occupational Health and Safety Agency (OSHA), Vermont OSHA (VOSHA), and United States Environmental Protection Agency (USEPA). 1.12.5 Contractor shall perform mold remediation services in accordance with a project-specific Mold Remediation Work Plan prepared for the State of Vermont by a Professional Engineer or qualified Mold Remediation Contractor. If the Project Manager determines that the project does not require a Mold Remediation Work Plan, then the Contractor shall perform mold remediation work in accordance with their subtask scope of work and recognized industry standards applicable to the work including, but not limited to, the following documents or the most recent revisions thereof: 1.12.5.1 American Industrial Hygiene Association (AIHA) – Recognition, Evaluation, and Control of Indoor Xxxx, 0000 1.12.5.2 American Conference of Governmental Industrial Hygienists (ACGIH) – Bioaerosols Assessment and Control, 1999 1.12.5.3 Institute of Inspection Cleaning and Restoration Certification (IICRC) – S520 Standard and Reference Guide for Professional Mold Remediation, published 2015 1.12.5.4 United States Occupational Safety and Health Administration (OSHA) – A Brief Guide to Mold in the Workplace, revised November 2013 1.12.5.5 United States Environmental Protection Agency (USEPA) – Mold Remediation in Schools and Commercial Buildings, published March 2001 1.12.6 The Contractor guarantees that all materials shall be of the best quality, that all work shall be done in a professional manner, and that all aspects of the project will be delivered in good working order, complete and perfect in every respect, and that all systems and materials necessary to make the project completely operational as contemplated by the above description of the project, even if those systems and materials are not specifically described in this Contract, shall be included in the contract price. 1.12.7 Contractor shall ensure that all supplies, equipment and machines shall be kept free of traffic lanes or other areas that may be hazardous. Contractor shall further ensure that all dirt and debris resulting from the work under this contract shall be disposed of at the end of each day or at the completion of work in each building. 1.12.8 Contractor shall, at no additional cost to the State, repair furnishings, equipment, facilities or other property of the State damaged by Contractor, its officers, employees, agents, contractors, subcontractors and invitees. Contractor acknowledges that the determination of the need for, and extent of, any repair work shall be made at the sole discretion of the Project Manager. 1.12.9 Contractor shall, upon request of the Project Manager, provide Safety Data Sheets for all chemicals to be used during the performance of work under this contract. Safety Data Sheets shall be provided no later than 72 hours prior to the performance of abatement or remediation work under this contract, except for emergency response work where the 72-hour requirement shall be waived. 1.12.10 It is the contractor’s responsibility to contact Dig-Safe prior to beginning any excavation work. For private complexes, such as prisons, the contractor will need to contact a private underground utility locator prior to beginning work.
