Xxxxxx Judgment. 5.2.5.1 The YAN and the United States acting as trustee for the YAN shall have the right to participate in the continuing administration of the Verde Ditch pursuant to the Conclusions of Law and Judgment entered on March 23, 1909, by the District Court of the Fourth Judicial District of the Territory of Arizona, in and for the County of Yavapai, in Xxxxx x. Xxxxxx et al., No. 4772, attached as Exhibit 5.2.5, including all successive orders thereto (hereafter “Xxxxx x. Xxxxxx Judgment”).
Xxxxxx Judgment. Xxxxxxxxx hereby represents and warrants that the Xxxxxx Judgment has been satisfied or otherwise vacated in full. The EMAV Companies hereby agree to indemnify Xxxxxx and his brother, Xxxxx Xxxxxx (“Xxxxx”), against and in respect of all demands, judgments, debts, obligations, interests, liabilities, causes of action, costs, expenses, and injunctions of any nature whatsoever, arising under the Xxxxxx Judgment.
