Governing Law and Venue. This EULA, and any disputes arising from it, will be governed exclusively by the applicable governing law below, based on Your primary place of business and without regard to conflicts of laws rules or the United Nations Convention on the International Sale of Goods. Governing Law and Venue. This Agreement shall be governed by and construed under the laws of the State of California without reference to its conflicts of law principles. In the event of any conflicts between foreign law, rules, and regulations, and United States of America law, rules, and regulations, United States of America law, rules, and regulations shall prevail and govern. Neither the United Nations Convention on Contracts for the International Sale of Goods nor the Uniform Computer Information Transactions Act as enacted shall apply to this Agreement. You and Extreme agree to submit to the exclusive jurisdiction of, and venue in, the state or federal courts located in California in any dispute arising out of or relating to this Agreement.
Governing Law and Venue. All disputes arising out of or relating to this Agreement, or its subject matter will be governed by the substantive laws as set forth in the table below based on Your primary place of business and regardless of and excluding rules relating to conflict of laws. The United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transactions Act do not apply to this Agreement. The courts listed below shall have exclusive jurisdiction to hear any dispute arising out of, or related to, this Agreement. Each Party agrees to the exclusive jurisdiction of such courts. Notwithstanding the foregoing, either Party may seek interim injunctive relief in any court of applicable jurisdiction with respect to any alleged breach of Intellectual Property Rights or the confidentiality terms herein.
