In addition to, and not in limitation of, the Holder’s other remedies under applicable law, including as provided herein, upon an Event of Default, the Holder shall file with the appropriate court of law the Affidavit of Confession of Judgment executed by the Company in connection with issuance of the Note, in the form attached as Exhibit A hereto.
To secure the payment of the obligations of the Guarantor under this Guaranty, the Guarantor has executed an Affidavit of Confession of Judgment in the form annexed hereto as Exhibit 1.

Mr. Arab also executed a personal guaranty and, personally and on behalf of TNG and M&A, he executed an Affidavit of Confession of Judgment (“the affidavit”).

The claim of Itria Ventures, LLC, to the extent Allowed as asecured claim against DAC under section 506 of the Code, arising pursuant to a Future Receivables Sales Agreement dated September 27, 2016 (the “Receivables Sales Agreement”) and/or Affidavit of Confession of Judgment (the “Confession of Judgment”) and/or Judgment entered on March 21, 2017 in the Supreme Court of the State of New York, Queens County (the ”NY Judgment”) and/or a Stipulation of Settlement executed May 2, 2017 (the “Settlement”).
To secure the payment of the obligations of the Guarantor under this Guaranty, the Guarantor has executed an Affidavit of Confession of Judgment in the form annexed hereto as Exhibit D.
Should any portion of the Principal Amount remain unpaid as of February 16, 2012, the Company hereby authorizes Holder to file an Affidavit of Confession of Judgment in the amount of two hundred and fifty thousand dollars ($250,000), without further notice.
