Assist in the transmission definition

Assist in the transmission means to provide substantial assistance or support that enables a person to formulate, compose, send, originate, initiate, or transmit a commercial electronic mail message when the person providing the assistance knows or has reason to know that the initiator of the commercial electronic mail message is engaged in or intends to engage in a practice that violates this chapter. “Assist in the transmission” does not include:
Assist in the transmission means actions taken by a person to provide substantial assistance or support, which enables any person to originate, initiate, or transmit a commercial solicitation when the person providing the assistance knows or avoids knowing that the initiator of the commercial solicitation is engaged, or intends to engage, in any practice is a violation. This does not include activities of: (1) any entity related to the design, manufacture, or distribution of any technology, product, or component that has a commercially significant use other than to violate or circumvent regulations; (2) a telecommunications provider or other entity that is limited to providing access to the internet for purposes excluding initiation of a voice communication; or (3) a terminating provider relating to the completion of a voice communication.
Assist in the transmission means actions taken by a person to procure, enable, finance, or otherwise actively support the transmission of a commercial electronic mail message by another person, if the person or entity providing the assistance knows or should have known that the initiator of the commercial electronic mail message is engaged, or intends to engage, in any practice that violates this act. The term “assist in the transmission” shall not include activities of any person or entity related to the design, manufacture, or distribution of any technology, product, or component that has a commercially significant use other than to violate or circumvent this act.

Examples of Assist in the transmission in a sentence

  • Assist in the transmission of a commercial electronic mail message, fax or wireless advertisement when the person providing the assistance knows or consciously avoids knowing that the initiator of the commercial electronic mail message or fax is engaged or intends to engage in any act or practice that violates the provisions of this act.

  • After the Administrative Agent’s resignation hereunder, the provisions of this Article VIII and Section 10.03 shall continue in effect for the benefit of such retiring Administrative Agent, its sub-agents and their respective Related Parties in respect of any actions taken or omitted to be taken by any of them while it was acting as Administrative Agent.

Related to Assist in the transmission

  • Transmission Owner means a Member that owns or leases with rights equivalent to ownership Transmission Facilities and is a signatory to the PJM Transmission Owners Agreement. Taking transmission service shall not be sufficient to qualify a Member as a Transmission Owner. Transmission Owner Attachment Facilities:

  • Regional Transmission Organization or “RTO” means the regional transmission organization approved by the Federal Energy Regulatory Commission for the control area that includes the utility’s assigned service area (as defined in IC 8-1-2.3-2).

  • Transmission Service means Point-To-Point Transmission Service provided under Tariff, Part II on a firm and non-firm basis.

  • Transmission Facilities shall have the meaning set forth in the Operating Agreement. Transmission Injection Rights:

  • CTU or Central Transmission Utility means the Central Transmission Utility as defined in Sub-Section (10) of section (2) of the EA-2003.

  • Transmission Services the services provided by the Transmission Provider(s) to the Distributor;
