Assumed Executory Contract and Unexpired Lease List definition

Assumed Executory Contract and Unexpired Lease List means the list, as determined by the Debtors or the Reorganized Debtors, as applicable, of Executory Contracts and Unexpired Leases (with proposed cure amounts) that will be assumed by the Reorganized Debtors, which list shall be included in the Plan Supplement.

Assumed Executory Contract and Unexpired Lease List means, as applicable, the EFH/EFIH Assumed Executory Contract and Unexpired Lease List or the TCEH Assumed Executory Contract and Unexpired Lease List.

Assumed Executory Contract and Unexpired Lease List means the list of Executory Contracts and Unexpired Leases that will be assumed by the Debtors pursuant to Article V of the Plan, which shall be included in the Plan Supplement.

• Entry of the Confirmation Order by the Bankruptcy Court shall constitute a Final Order approving the assumptions and assumptions and assignments of the Executory Contracts and Unexpired Leases as set forth in the Plan and the Assumed Executory Contract and Unexpired Lease List and the rejections of the Executory Contracts and Unexpired Leases as set forth in the Rejected Executory Contract and Unexpired Lease List, pursuant to sections 365(a) and 1123 of the Bankruptcy Code.

More Definitions of Assumed Executory Contract and Unexpired Lease List

Assumed Executory Contract and Unexpired Lease List means the list (as may be amended), as determined by the WV Debtors or the Reorganized Debtors, of Executory Contracts and Unexpired Leases (including any amendments or modifications thereto) that will be assumed by the Reorganized Debtors pursuant to the provisions of Article V.A of the Plan. The Connecticut Master Lease and the Massachusetts Master Lease shall be amended and assumed as provided in Article V.J of the Plan and shall be included on any Assumed Executory Contract and Unexpired Lease List.

Assumed Executory Contract and Unexpired Lease List means the list, as determined by the Debtors or the Reorganized Debtors, as applicable, of Executory Contracts and Unexpired Leases that will be assumed by the Reorganized Debtors pursuant to the Plan, which list shall be included in the Plan Supplement; provided, that such list shall be reasonably acceptable to the Required Consenting Parties and the Committee.

Assumed Executory Contract and Unexpired Lease List means the list (as may be amended at any time prior to the Effective Date), as determined by Tronox, of Executory Contracts and Unexpired Leases (including any amendments or modifications thereto) that will be assumed by Tronox or assumed by Tronox and assigned to any of the Environmental Response Trusts, the Tort Claims Trust or the Anadarko Litigation Trust pursuant to the provisions of Article V; provided, however, that to the extent Tronox proposes to assume and assign an Executory Contract or Unexpired Lease to the Environmental Response Trusts or the Tort Claims Trust, Tronox will obtain the consent (which consent shall not be unreasonably withheld) of the Government Environmental Entities or the Creditors’ Committee, as applicable, with respect to the assignment of such contract or lease.

Assumed Executory Contract and Unexpired Lease List means the list of Executory Contracts and Unexpired Leases that will be assumed, subject to the consent of the Consenting Parties, by the Reorganized Debtors pursuant to the Plan, which list shall be included in the Plan Supplement.

Assumed Executory Contract and Unexpired Lease List means the list, as determined by the Debtors or the Reorganized Debtors, as applicable, in consultation with the DIP Lender and the Prepetition Lender, of Executory Contracts and Unexpired Leases (with proposed cure amounts) that will be assumed by the Reorganized Debtors, which list shall be included in the Plan Supplement as may be amended, modified, or otherwise supplemented from time to time by the Debtors or Reorganized Debtors, as applicable, in accordance with the Plan. For the avoidance of doubt, each of the Debtors’ management agreements with Regus Management Group, LLC and each of the Debtors’ franchise agreements with Franchise International S.A.R.L. (a) are deemed Assumed Executory Contracts and Unexpired Leases, (b) shall be included on the Assumed Executory Contract and Unexpired Lease List,(c) shall reflect a cure amount as stipulated and agreed to among the Debtors, Regus Management Group, LLC, and Franchise International S.A.R.L., and (d) shall not be rejected or removed from the Assumed Executory Contract and Unexpired Lease List without the consent of Regus Management Group, LLC or Franchise International S.A.R.L., as applicable.

Assumed Executory Contract and Unexpired Lease List means the list, as determined by the Debtors or the Reorganized Debtors, as applicable, of certain Executory Contracts and Unexpired Leases to be assumed by the Reorganized Debtors pursuant to the Plan, as the same may be amended, modified, or supplemented from time to time by the Debtors or Reorganized Debtors, as applicable, in accordance with the Plan, which list shall be included in the Plan Supplement.

Assumed Executory Contract and Unexpired Lease List means the list (as may be amended from time to time), as determined jointly by the Committee and the Debtors or the Reorganized Debtors, of Executory Contracts and Unexpired Leases (including any amendments or modifications thereto) that will be assumed by the Reorganized Debtors pursuant to Article VI of the Plan, it being understood that to the extent the Plan, the Disclosure Statement, or any of the exhibits filed with the Disclosure Statement provides that a given Executory Contract or Unexpired Lease will be assumed or rejected, then such Executory Contract or Unexpired Lease will be included in, or excluded from, the Assumed Executory Contract and Unexpired Lease List, as necessary to give effect to such provision.
