Attributable to Network Rail definition

Attributable to Network Rail has the meaning attributed to it in Schedule 8 of this contract;
Attributable to Network Rail means, in respect of any delay to or cancellation of a Service or any other matter:
Attributable to Network Rail means, in respect of any delay to or cancellation of a Combined Network Service or any other matter: any delay or cancellation or other matter, occurring on or off the Combined Network, which is not Attributable to the Train Operator; any delay to, or cancellation of, a Combined Network Restriction of Use, which is not Attributable to the Train Operator; that portion of any such delay to or cancellation of a Combined Network Service that would otherwise be Attributable to both the Train Operator and Network Rail, but which the parties agree, or it is otherwise determined, is Attributable to Network Rail; any delay or cancellation occurring on or off the Combined Network, caused by an Other Train Operator Train on the Combined Network; or prior to the implementation of any ETCS Amendments in accordance with paragraph 12, any delay to or cancellation of a Combined Network Service occurring on the Combined Network or that prevents that Combined Network Service accessing the Combined Network caused by the failure, defect or miscommunication of ETCS Equipment fitted to the Specified Equipment (excluding any such failure, defect or miscommunication directly caused by the Deliberate Act of the Train Operator) that has been allocated as the responsibility of the Train Operator in the Performance Monitoring System in accordance with the guidance on allocation of responsibility for incidents set out in the Delay Attribution Principles and Rules, and which excludes any such delay to or cancellation of a Combined Network Service or any other matter arising as a result of a Planned Incident, in all cases having regard to the guidance on allocation of responsibility for incidents set out in the Delay Attribution Principles and Rules;

Examples of Attributable to Network Rail in a sentence

  • If the cause of the delay to or cancellation of a Service which occurs on the Network cannot be explained, the responsibility for such delay or cancellation shall be deemed to be Attributable to Network Rail.

  • If the cause of the delay to or cancellation of a Combined Network Service which occurs on the Combined Network cannot be explained, the responsibility for such delay or cancellation shall be deemed to be Attributable to Network Rail.

  • No Track Charges shall be payable by the Train Operator in respect of a Train Slot when the train has not reached its Planned Destination for a reason which is Attributable to Network Rail.

  • Network Rail shall have no liability under any provision of this Schedule 8 to the Train Operator in respect of any Delay or Cancellation to any Train Operator Service (whether that delay shall be Attributable to Network Rail or Attributable to both the Train Operator and Network Rail).

  • If a Delay is Attributable to Network Rail, Network Rail shall have no liability to the Train Operator for that Delay.

  • Attributing delays Network Rail shall, using the information recorded under paragraph 2.1, identify whether each minute of delay included in Minutes Delay in respect of a Combined Network Service or Third Party Train is: Attributable to the Train Operator; Attributable to Network Rail; or Attributable to both the Train Operator and Network Rail.

  • No Track Charges shall be payable by the Train Operator in respect of a Train Slot when the train has not reached its Planned Destination for a reason which: is Attributable to Network Rail (as defined in the Network Rail TAC (Freight Services)) insofar as it relates to the CVL, where the Network Rail TAC (Freight Services) applies pursuant to paragraph 1A of Schedule 8; or is Attributable to the CVL IM, where the Network Rail TAC (Freight Services) does not apply pursuant to paragraph 1A of Schedule 8.

  • Network Rail shall, using the information recorded under paragraph 2.1, identify whether each minute of delay included in Minutes Delay in respect of a Combined Network Service or Third Party Train is: Attributable to the Train Operator; Attributable to Network Rail; or Attributable to both the Train Operator and Network Rail.

Related to Attributable to Network Rail

  • System with a single service connection means a system which supplies drinking water to consumers via a single service line.

  • Production, Use or Storage of Nuclear Material means the production, manufacture, enrichment, conditioning, processing, reprocessing, use, storage, handling and disposal of Nuclear Material.

  • Standard Methods for the Examination of Water and Wastewater means the most recent edition of Standard Methods for the Examination of Water and Wastewater published jointly by the American Public Health Association, the American Waterworks Association and the Water Environment Federation;

  • Enrollee point-of-service cost-sharing or "cost-sharing" means amounts paid to health carriers directly providing services, health care providers, or health care facilities by enrollees and may include copayments, coinsurance, or deductibles.

  • maximum content of non-originating materials means the maximum content of non-originating materials which is permitted in order to consider a manufacture to be working or processing sufficient to confer originating status on the product. It may be expressed as a percentage of the ex-works price of the product or as a percentage of the net weight of these materials used falling under a specified group of chapters, chapter, heading or subheading;

  • Nominal tomographic section thickness means the full width at half-maximum of the sensitivity profile taken at the center of the cross-sectional volume over which x-ray transmission data are collected.

  • Portable tank means a storage tank along with its piping and wiring that is not stationary or affixed, including a tank that is on skids.

  • Subloop shall have the meaning set forth in Section 9.3.1.

  • National Pollutant Discharge Elimination System Permit or “NPDES” means a permit issued by the MPCA as required by federal law for the purpose of regulating the discharge of pollutants from point sources into waters of the United States from concentrated animal feeding operations (CAFOs) as defined by federal law

  • Acid rain emissions limitation means, as defined in 40 CFR 72.2*, a limitation on emissions of sulfur dioxide or nitrogen oxides under the acid rain program under Title IV of the Clean Air Act (CAA).

  • National Pollutant Discharge Elimination System (NPDES) means the national program for issuing, modifying, revoking and reissuing, terminating, monitoring, and enforcing permits and imposing and enforcing pretreatment requirements, under Sections 307, 318, 402, and 405 of CWA. The term includes an approved program.

  • Underground source of drinking water means an aquifer or its portion:

  • AT&T-12STATE means the AT&T owned ILEC(s) doing business in Arkansas, California, Illinois, Indiana, Kansas, Michigan, Missouri, Nevada, Ohio, Oklahoma, Texas and Wisconsin.

  • National Ambient Air Quality Standards or “NAAQS” means national ambient air quality standards that are promulgated pursuant to Section 109 of the Act, 42 U.S.C. § 7409.

  • Non-potable water means water not safe for drinking, personal, or culinary use as determined by the requirements of 35 Ill. Adm. Code 604.

  • 911 Trunk A trunk capable of transmitting a 9-1-1 dialed call to the Selective Router, and used for the single purpose of transmission of 9-1-1 calls in accordance with applicable NENA Standards. Access Service Request (ASR): The Ordering and Billing Forum document designated by CenturyLink to be used by the Parties to add, establish, change or disconnect services or trunks for the purpose of providing special access, Switched Access Services, and Interconnection. Act or the Act: The Communications Act of 1934, as amended by the Telecommunications Act of 1996, and as amended from time to time and codified at 47 ACTL: Access Customer Terminal Location as defined by Telcordia.

  • Peak tube potential means the maximum value of the potential difference across the x-ray tube during an exposure.

  • Custom Local Area Signaling Service Features (CLASS) means certain call-management service features that are currently available from SBC-13STATE’s local networks. These could include: Automatic Call Back; Automatic Recall; Call Trace; Caller Identification and related blocking features; Calling Number Delivery; Customer Originated Trace; Distinctive Ringing/Call Waiting; Selective Call Forward; and Selective Call Rejection.

  • Cabinet x-ray system means an x-ray system with the x-ray tube installed in an enclosure independent of existing architectural structures except the floor on which it may be placed. The cabinet x-ray system is intended to contain at least that portion of a material being irradiated, provide radiation attenuation, and exclude personnel from its interior during generation of radiation. Included are all x-ray systems designed primarily for the inspection of carry-on baggage at airline, railroad, and bus terminals, and in similar facilities. An x-ray tube used within a shielded part of a building, or x-ray equipment that may temporarily or occasionally incorporate portable shielding, is not considered a cabinet x-ray system.

  • 911 system means the set of network, database and customer premise equipment (CPE) components required to provide 911 service.

  • Railway Corridor means, prior to the grant of a Special Railway Licence, the land for the route of the Railway the subject of that licence, access roads (other than Lateral Access Roads), areas from which stone, sand, clay and gravel may be taken, temporary accommodation facilities for the railway workforce, water bores and Additional Infrastructure (if any) which is the subject of a subsisting agreement pursuant to subclause (3)(a) and after the grant of the Special Railway Licence the land from time to time the subject of that Special Railway Licence;
