BEE Status definition

BEE Status means the BBBEE rating, standing, classification and/or measurement (or its equivalent) as contemplated under the codes of good practice on BBBEE, as the case may be, attributable to any entity;

BEE Status means in relation to a Black Group, the Black Group’s percentage ownership and percentage economic interest held by Black People (by shareholding, membership, beneficiary interest or other comparable interest, as the case may be, having regard to the juristic nature of the relevant Black Group) and the Black Group’s percentage representation by Black People at board or trustee or other similar governing body and, in relation to a natural person, whether or not that person qualifies as a Black Person;

• During this phase, bid responses will be reviewed for the purposes of assessing compliance with RFP requirements including the general bid conditions, which requirements include the following: Submission of a valid Tax Clearance Certificate with a tax compliance status PIN. Submission of Company Registration Documents. BEE Status Certification as referenced above. Completion of all Standard Bidding Documents and other requirements, as reflected in this RFP.

• The BEE Codes of Good Practice were gazetted on 9 February 2007 under section 9(1) of the B-BBEE Act of 2003.According to the revised PPPF Act of 2011, BEE Status Level Certificates were to be implemented.

• This includes initiatives implemented where the economic benefits received as a result of the BEE Status of an Enterprise do not flow to black people in the ratio as specified in the relevant legal documentation.
