The Port has held this Property in trust for the people of the State of California since 1969 pursuant to the California Burton Act (statutes 1698, ch 1333).
The provisions of this section are applicable to all buildings and structures of all occupancies within the jurisdiction of the San Francisco Port Commission as set forth within Section 3 of Statutes 1968, ch.1333 (The Burton Act).
Nothing in this act shall be construed as limiting the port’s existing authority to use or lease the designated seawall lots under the Burton Act, subject to any applicable limitations of state law.

Nothing in this section shall be construed as limiting the term of any lease, or portion thereof, that is for uses consistent with the public trust and the Burton Act.
Nothing in this Initiative is intended to supersede, affect or conflict with the authority of the State Lands Commission or the Port Commission under the Pier 70 Exchange Act, the public trust for commerce, navigation and fisheries, the Burton Act (Chapter 1333 of the Statutes of 1968) or any other regional, state or federal agency having jurisdiction to review and approve the development plan to the extent provided under all applicable laws.

Under the Burton Act, a state law that governs the Port’s authority, the Port could not enter into a lease of more than 66 years in length; thus, the maximum term the arena could be leased would be 66 years.
