Where an inspector makes an inspection of a workplace under the powers conferred upon them under the Occupational Health and Safety Act, the Employer shall afford a committee member representing workers the opportunity to accompany the inspector during their physical inspection of a workplace, or any part or parts thereof.
The OH&S committee must operate within the requirements of the Occupational Health and Safety Act 2004 (Vic).
The Parties will comply with all applicable law, including but not limited to the Personal Information Protection and Electronic Documents Act, Occupational Health and Safety Act, Employment Standards Act, and any other relevant employment related legislation or regulations.
Such mechanisms will be: in accordance with the Victorian Occupational Health and Safety Act 2004; established in consultation with Employees and their health and safety representatives; and consistent with the Employer’s agreed issue resolution procedures and the rights and functions of health and safety representatives, consistent with the Occupational Health and Safety Act 2004 (Vic).
The parties to this Collective Agreement will co-operate to the fullest extent in the matter of occupational health as addressed in the Occupational Health and Safety Act.
