A Contractor may not institute legal action, prior to receipt of the Purc claim, unless the Purchasing Agent fails to render such decision within the time specified.

Upon delivery of such notice from the Issuer, the Callable Warrants shall not be redeemed, but shall instead be subject to mandatory tender on the date that would have been the optional redemption date at a purchase price equal to the redemption price that would have been payable with respect to such Callable Warrants.
