Category 1 Request definition

Category 1 Request. As defined in the Post Closing Matters Description in Exhibit B-2.
Category 1 Request means a "Category 1 Request" and a "Deemed Category 1 Request" as such terms are defined in the Primary Servicing Agreement.
Category 1 Request. In connection with the PCF Pooled Mortgage Loans and PCFII Pooled Mortgage Loans, a "Category 1 Request" and a "Deemed Category 1 Request" as such terms are defined in the PGI Primary Servicing Agreement.

Examples of Category 1 Request in a sentence

  • Such evaluation and processing may commence, and continue but may not be completed prior to Primary Servicer's notice to Master Servicer of the Category 1 Request or Deemed Category 1 Request.

  • Primary Servicer shall draft, or cause to be drafted, all documents necessary or appropriate to effect the Category 1 Request or Deemed Category 1 Request in accordance with the terms of the Loan Documents, this Agreement and the Pooling and Servicing Agreement with respect to an A/B Mortgage Loan, the applicable A/B Intercreditor Agreement.

  • If Primary Servicer classifies a Post Closing Request as a Category 1 Request or Deemed Category 1 Request, it shall promptly (but in no event more than five (5) Business Days after receiving such request) notify Master Servicer of (a) such request; (b) Primary Servicer's classification of the Post Closing Request as a Category 1 Request or Deemed Category 1 Request; and (c) Primary Servicer's Materiality Determination regarding any Category 1 Consent Aspect involved in such request.

  • Primary Servicer's decision in any one instance to treat a Post Closing Request that otherwise qualifies as a Category 1 Request or Deemed Category 1 Request, as a Category 2 Request instead, shall not compromise or affect its right on any other occasion to treat a similar request as a Category 1 Request or Deemed Category 1 Request.

  • Such request shall not relieve Primary Servicer of its obligations under this Agreement regarding a Category 1 Request or Deemed Category 1 Request, including without limitation its obligation to evaluate and process such request in accordance with this Agreement and the Pooling and Servicing Agreement and with respect to an A/B Mortgage Loan, the related A/B Intercreditor Agreement and any indemnification obligation of Primary Servicer.

  • Category 1: Request for specific information about putative class members.

  • Primary Servicer shall evaluate the Category 1 Request or Deemed Category 1 Request and process such request to meet the requirements set forth in the loan documents for the applicable Mortgage Loan ("Loan Documents") in a manner that complies with the terms of this Agreement and the Pooling and Servicing Agreement and with respect to an A/B Mortgage Loan, the applicable A/B Intercreditor Agreement.

  • Such evaluation and processing may commence, and continue but may not be completed prior to Primary Servicer's notice to Capmark Master Servicer of the Category 1 Request or Deemed Category 1 Request.

  • If the Pooling and Servicing Agreement requires the Master Servicer to deliver originals or copies of any documents executed in connection with a Category 1 Request or Category 2 Request, the Primary Servicer shall promptly upon the closing of the transaction deliver such document or copy to the Master Servicer and each Person to whom the Master Servicer is required to deliver such document or copy under the Pooling and Servicing Agreement.

More Definitions of Category 1 Request

Category 1 Request. In connection with the PCF Pooled Mortgage Loans, a "Category 1 Request" and a "Deemed Category 1 Request" as such terms are defined in the PCF Primary Servicing Agreement.
Category 1 Request means a "Category 1 Request" and a "Deemed Category 1 Request" as such terms are defined in the Principal Global Investors, LLC Primary Servicing Agreement.
Category 1 Request any Borrower request for, or any action to permit or consent to, any modification, extension, waiver, defeasance, consent or other action contemplated by Section 3.19(d) or 3.20 of the Pooling and Servicing Agreement that either (a) is specifically authorized in the related Mortgage Loan Documents, either expressly as a matter of right in favor of the Mortgagor or upon the satisfaction of certain specified conditions (including the exercise of any specified standard of consent or judgment within such conditions subject to the terms of this Agreement); or (b) seeks the approval of the related Mortgagee under the related Mortgage Loan Documents for a lease (other than a Significant Lease and other than the granting of a subordination and nondisturbance or attornment agreement for any lease (whether or not a Significant Lease)); provided that a Category 1 Request shall not include (i) any approval of a Significant Lease or the granting of a subordination and nondisturbance or attornment agreement for any lease (whether or not a Significant Lease) or (ii) any matter or action for which the Pooling and Servicing Agreement requires the Master Servicer to obtain the consent or approval of the Special Servicer (including, without limitation, a Special Servicer Decision or a Material Action).

Related to Category 1 Request

  • Commercial use request means a re- quest from or on behalf of one who seeks information for a use or purpose that furthers the commercial, trade, or profit interests of the requester or the person on whose behalf the request is made.

  • Support Request means a request for assistance received by Blackboard's Service Desk and/or Service Desk Infrastructure from an Authorized User, such as any answered phone call, answered email, or answered chat.

  • L/C Request has the meaning specified in Section 2.4(b).

  • Work request means a document prepared by the Contractor which describes over and above work being proposed.

  • Service Request means a request for service such as adds, moves, changes and technical assistance;

  • Urgent care request means a claim relating to an admission, availability of care, continued stay or health care service for which the covered person received emergency services but has not been discharged from a facility, or any Pre-Service Claim or concurrent care claim for medical care or treatment for which application of the time periods for making a regular external review determination:

  • Release Request has the meaning set forth in Section 2.1.

  • Access Request means a request for access to Facilities and/or Services on the Access List made by the Access Seeker under subsection 5.4.5 of the MSA Determination and containing the information in subsection 5.4.6 of the MSA Determination and in Clause 5(b) hereof and as per the format in Appendix A hereof.

  • Change Order Request means a written request or proposal for a Change Order submitted by either Company or Contractor and including:

  • Investment Request means a letter in substantially the form of Exhibit A hereto executed and delivered by the Seller to the Administrative Agent and the Purchasers pursuant to Section 2.02(a).

  • First Level Support means any support relating to calls from Customer’s customers, end users or affiliates or general resolution of user errors, network errors, provisioning errors or Internet delays or malfunctions.

  • Opt-Out Request has the meaning ascribed to such term in Section 4.16.

  • Draw Request Any request by the Borrower, pursuant to Section 2.2 of this Agreement, for a disbursement of any portion of the proceeds of the Loan.

  • Access Service Request (ASR) is an industry standard form used by the Parties to add, establish, change or disconnect trunks for the purposes of Interconnection.

  • Direction-indicator lamp means the lamp used to indicate to other road-users that the driver intends to change direction to the right or to the left;

  • New Service Request means an Interconnection Request, a Completed Application, or an Upgrade Request.

  • Participating Certified Clinical Nurse Specialist means a Certified Clinical Nurse Specialist who has a written agreement with the Claim Administrator or another Blue Cross and/or Blue Shield Plan to provide services to you at the time services are rendered.

  • Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

  • Funding Request shall have the meaning set forth in Section 5.3(a).

  • Advance Request means a request for an Advance submitted by Borrower to Lender in substantially the form of Exhibit A.

  • Data Subject Access Request means a request made by a Data Subject in accordance with rights granted pursuant to the DPA to access his or her Personal Data;

  • Direct Debit Request means the Direct Debit Request between Us and You.

  • Bona Fide Request (BFR) is the process described in the applicable Appendix UNE.

  • Subject Access Request means a request for Personal Data falling within the provisions of Section 7 of the DPA and Article 11, 12 & 15 of the GDPR

  • Direct request means a petition filed by an individual in a tribunal of this state in a proceeding involving an obligee, obligor, or child residing outside the United States.
