During his absence or inability to act and during any vacancy in the office of President of the Bank, the person for the time being acting as President shall act as Chairman of the Administrative Council.
The President of the Bank shall be ex officio Chairman of the Administrative Council (hereinafter called the Chairman) but shall have no vote.
Article 2828 Board(1) When there are at least eight Contracting States, the Administrative Council may set up a Board composed of five of its members.(2) The Chairman and the Deputy Chairman of the Administrative Council shall be members of the Board ex officio; the other three members shall be elected by the Administrative Council.(3) The term of office of the members elected by the Administrative Coun- cil shall be three years.

By letter of 30 May 2006, the Parties informed ICSID that they had reached agreement on the method, according to which the Tribunal was to consist of three arbitrators, one appointed by each party within a certain time limit and the presiding arbitrator (the President of the Tribunal) to be appointed by agreement of the Parties by 17 August 2006, failing which the appointment would be made by the Chairman of the Administrative Council of ICSID.
The Parties were unable to agree on a third arbitrator to serve as the President of the Tribunal and consequently invoked Article 38 of the ICSID Convention to request that the Chairman of the Administrative Council designate the President of the Tribunal.
The Parties having failed to reach agreement on the presiding arbitrator, the Claimant, by letter dated 21 August 2006, requested that the Chairman of the Administrative Council of ICSID appoint the presiding arbitrator.
If the Commission is not constituted within 90 days after the dispatch by the Secretary-General of the notice of registration, or such other period as the parties may agree, either party may, through the Sec- retary-General, address to the Chairman of the Administrative Council a request in writing to appoint the conciliator or conciliators not yet appointed and to designate a conciliator to be the President of the Commission.
On November 12, 2001, the parties agreed the Tribunal would consist of three arbitrators, one to be appointed by each party and the third arbitrator and President of the Tribunal to be appointed by the Chairman of the Administrative Council of the Centre.
