Clean closure determination definition

Clean closure determination means a determination by the Department that all wastes and waste residues; all contaminated system components, structures and equipment; and all soil, sediment, groundwater, and surface water at a contaminated site have been removed or decontaminated to the extent necessary to protect human health and the environment. Applicants for a clean closure determination without controls must demonstrate that they meet cleanup target levels for risk management option level I pursuant to subsection 62-780.680(1), F.A.C. The termno further action” refers only to sites that receive a clean closure determination without controls. Applicants for a clean closure determination with controls must demonstrate that they meet the cleanup target levels for risk management option level II or III pursuant to subsections 62-780.680(2) and (3), F.A.C. The term “no further action with controls” refers to sites that receive a clean closure determination with controls. “Sites” as used in this paragraph means solid waste management units (SWMUs), regulated hazardous waste management units, and areas of concern (AOCs).

  • SOFR Determination Time means 3:00 p.m. (New York time) on the U.S. Government Securities Business Day, at which time Compounded SOFR is published on the FRBNY’s Website.

  • Flood Elevation Determination means a determination by the Administrator of the water surface elevations of the base flood, that is, the flood level that has a one percent or greater chance of occurrence in any given year.

  • Current closure cost estimate means the most recent of the estimates pre- pared in accordance with § 265.142 (a), (b), and (c).

  • Books Closure Date means the date and time to be determined by the Manager on which the register of Unitholders will be closed for the purpose of determining the entitlements of Unitholders to a Distribution;

  • Final Closing Statement has the meaning set forth in Section 2.4(a).

  • Adverse determination shall have the meaning set forth in Section 19.7.

  • Claim Determination Period means a calendar year. However, it does not include any part of a year during which a person has no coverage under This Plan, or any part of a year before the date this COB provision or a similar provision takes effect.

  • Self-Determination means a philosophy and process by which individuals with developmental disabilities are empowered to gain control over the selection of support services that meet their needs. The basic principles of self-determination are:

  • Construction Completion Date means the date by which the overall development of the Project is completed in accordance with the provisions of this Agreement and when the Construction Completion Certificate is issued by the Independent Engineer as per Article 14.1.

  • Final Determination Date means the following:

  • Pre-Closing Statement has the meaning set forth in Section 2.4(a).

  • Release detection means determining whether a release of a regulated substance has occurred from the UST system into the environment or into the interstitial space between the UST system and its secondary barrier or secondary containment around it.

  • Early Closure means the closure on any Exchange Business Day of the Exchange or the Related Exchange(s) prior to its closing time, unless such earlier closing time is announced by the Exchange or Related Exchange(s) at least one hour prior to the earlier of: (i) the actual closing time for the regular trading session on the Exchange or Related Exchange(s) on such Exchange Business Day and (ii) the submission deadline for orders to be entered into the Exchange or Related Exchange system for execution at the Valuation Time on such Exchange Business Day.

  • Initial determination means the first child custody determination concerning a particular child.

  • Adverse Benefit Determination means any of the following:

  • Time of Determination means the time and date of the earlier of (i) the determination of stockholders entitled to receive rights, warrants, or options or a distribution, in each case, to which Sections 3(h)(ii) or (iii) apply and (ii) the time ("Ex-Dividend Time") immediately prior to the commencement of "ex-dividend" trading for such rights, warrants or distribution on such national or regional exchange or market on which the Common Stock is then listed or quoted.

  • Final Approval Hearing means the hearing before the Court where the Parties will request the Final Judgment to be entered by the Court approving the Settlement Agreement, the Fee Award, and the incentive award to the Class Representative.

  • Extension Determination Date means, in respect of a Series of Covered Bonds, the date falling two Business Days after the expiry of seven days from (and including) the Final Maturity Date of such Covered Bonds.

  • Post-closure plan means a plan indicating the actions to be taken for the care, maintenance, and monitoring of the Development after closure, that will prevent, mitigate, or minimize the threat to public health and the environment;

  • Financial Closure means compliance with the requirements under Article 3.1 of this Agreement;

  • Permanent Closure means ceasing operation of all or any part of the facility with the intent that the animal holding area(s) and/or manure storage area(s) will no longer be used for that purpose.

  • The Completion Date means the date of completion of the Works as certified by the Employer’s Representative.

  • Event Determination Date means either:

  • Partial closure means the closure of a hazardous waste management unit in accordance with the applicable closure requirements of Sections 264 and 265 of this regulation at a facility that contains other active hazardous waste management units. For example, partial closure may include the closure of a tank (including its associated piping and underlying containment systems), landfill cell, surface impoundment, waste pile, or other hazardous waste management unit, while other units of the same facility continue to operate.
