In the event the Company joins such a lawsuit and receives money as part of an award or settlement, the Company may retain such moneys where the cost to return them would exceed fifty percent (50%) of the amount returnable or where the money is not identified with an individual Client or Member.
All benefits that pertain to a MEMBER will be paid by check to the order of Client or Member, unless the Client or Member requests otherwise, or HMO, in its discretion, considers it preferable to make the payment in another manner.

Upon request by Client or Member, the Formulary will be promptly provided in a mutually acceptable format for distribution by Client to Members.
