Such benefits shall continue to be provided until death-in-service benefits are provided by the Broadly Comparable Scheme.
All costs incurred in connection with the Admission Agreement and/or obtaining a certificate of broad comparability from the Government Actuary’s Department shall be borne by DBFM Co. DBFM Co shall procure that each Broadly Comparable Scheme shall be able to accept bulk transfers from the LGPS.
In respect of the Pensionable Authority Employees, the Authority shall use reasonable endeavours to ensure that the relevant Administering Authority transfers from the Fund to the Broadly Comparable Scheme on the Due Date an amount in respect of the Employee Transferring Members' service in the Fund before the Relevant Service Transfer Date calculated in accordance with the Actuary’s Letter and Regulation 9 of the LGPS Regulations.
The Authority shall provide DBFM Co with such information as it (or any Service Provider) may reasonably require in relation to the LGPS to enable DBFM Co (or any relevant Service Provider) to submit a proposal to the Government Actuary’s Department to assess the comparability of the Broadly Comparable Scheme.
In respect of its own LGPS Participant Employees, each Local Authority Participant shall use reasonable endeavours to ensure that the relevant Administering Authority transfers from the Fund to the Broadly Comparable Scheme on the Due Date an amount in respect of the relevant Transferring Members' service in the Fund before the Transfer Date calculated in accordance with the Actuary’s Letter and Part 9 of the LGPS (Administration) Regulations.
Where the Broadly Comparable Scheme has not been established by the Transfer Date (or Cessation Date (as the case may be)) the NHS Participant Employees and the LGPS Participant Employees shall be provided with benefits in respect of death-in-service which are no less favourable than the death-in-service benefits provided by the NHS Pension Scheme or the LGPS (as applicable) before the Transfer Date (or Cessation Date (as the case may be)).
In respect of its own NHS Participant Employees, each NHS Participant shall request that the SPPA shall invite each NHS Participant Employee who joins the Broadly Comparable Scheme to elect to a transfer from the NHS Pension Scheme to the Broadly Comparable Scheme in respect of their pensionable service accrued in (or credited in) the NHS Pension Scheme before the Transfer Date.
Subject to the Transfer Conditions being and remaining satisfied in all respects and the Employer complying in all material respects with its obligations under this Schedule, the relevant NHS Participant shall request that on the Pension Payment Date, the SPPA shall pay the Transfer Payment to the Broadly Comparable Scheme in full and final satisfaction of all interests (other than in relation to the AVC Fund) of or in respect of the Transferring Members under the NHS Pension Scheme.
If the transfer payment actually paid by the Broadly Comparable Scheme is less than the bulk transfer payment which would have been paid had Paragraph 7.1 been complied with then hubco shall procure that the Employer shall pay to the new employer the amount of the difference.
JVCo shall (and shall procure that each relevant Sub-Contractor shall) ensure that the Broadly Comparable Scheme provides benefits for each relevant Transferring LGPS Member which are equivalent to the value of the assets transferred.
