Compound Patents definition

Compound Patents shall have meaning assigned to such term in Section 8.2.4(a).

Compound Patents means all patents and patent applications owned by ProTides as at the Commencement Date or at any time during the period of this Agreement which relate to protides of nucleosides, including:

Examples of Compound Patents in a sentence

  • At the time each such PCT Application enters the national or regional phase in any country in the Santaris Territory, Santaris shall thereafter direct the filing, prosecution (including any interferences, oppositions, reissuance, and re-examinations) and maintenance of all LNA Compound Patents in countries in the Santaris Territory.

  • If BMS desires not to exercise its right to pursue patent protection with respect to certain Collaboration Compound Know-How, Collaboration Compound Patents, Collaboration Target Know-How or Collaboration Target Patents, then BMS shall notify FivePrime to that effect.

  • The Parties shall cooperate with each other in obtaining patent term restoration, extensions or supplemental protection certificates or their equivalents in any country in the Enzon Territory where applicable to LNA Compound Patents.

  • Within sixty (60) days after the end of each Enzon Quarter, each Party shall submit to the other Party an accounting of all costs Enzon incurs with regard to the filing and prosecution of such priority and PCT Applications for the LNA Compound Patents during that quarter and within thirty (30) days thereafter, the applicable Party shall reimburse the other Party such amount as may be required in accordance with the foregoing agreed allocation of such costs.

  • In the case of Enzon only, if Santaris or any of its Affiliates commences or otherwise, directly or indirectly, pursues (or voluntarily assists Third Parties to do so, other than as required by law or legal process) any proceeding seeking to have any of the Enzon Pegylation Patents or LNA Compound Patents revoked or declared invalid, unpatentable, or unenforceable (other than in defense of a claim by Enzon against Santaris).


More Definitions of Compound Patents

Compound Patents means the patents and patent applications set out in Part II of Schedule 2;
Compound Patents means any Patents that claim: (i) an Active Compound and/or a Research Program Compound; and/or any precursor, intermediate or starting material used to make the Active Compound and/or the Research Program Compound and/or any related compounds of any of the foregoing that are claimed in the Compound Patents; or (ii) methods of making or using any compositions containing any of the compounds specified in subparagraph i) above.
Compound Patents shall have meaning assigned to such term in Section 8.1.1(b)(i).
Compound Patents means the valid and/or pending Patents which [****].
Compound Patents means any Patents claiming matters of composition of the Compound.
Compound Patents means the Patents listed in Exhibit B, and any Patents issuing after the Effective Date in the Territory claiming priority to any such Patents listed on Exhibit B.
Compound Patents means the patents licensed by Licensor under the Exclusive License Agreement, including those listed on Appendix 1A (Compound Patents).
