Constituents of Concern definition

Constituents of Concern any substance defined as a hazardous substance, hazardous waste, hazardous material, pollutant or contaminant by any Environmental Law, any petroleum hydrocarbon and any degradation product of a petroleum hydrocarbon, friable asbestos, or PCBs, the handling, storage, treatment or exposure of or to which is subject to regulation under any Environmental Law.

Examples of Constituents of Concern in a sentence

  • Engineer may, after giving seven days written notice to Owner, suspend services under this Agreement if Owner has failed to pay Engineer for invoiced services and expenses, as set forth in Paragraph 4.02.B, or in response to the presence of Constituents of Concern at the Site, as set forth in Paragraph 6.10.D.

  • It is acknowledged by both parties that Engineer’s scope of services does not include any services related to unknown or undisclosed Constituents of Concern.

  • Owner represents to Engineer that to the best of its knowledge no Constituents of Concern, other than those disclosed in writing to Engineer, exist at the Site.

  • If investigative or remedial action, or other professional services, are necessary with respect to undisclosed Constituents of Concern, or if investigative or remedial action beyond that reasonably contemplated is needed to address a disclosed or known Constituent of Concern, then Engineer may, at its option and without liability for consequential or any other damages, suspend performance of services on the portion of the Project affected thereby until such portion of the Project is no longer affected.

More Definitions of Constituents of Concern

Constituents of Concern means the specific regulated substances that may contribute to unacceptable exposure at a site.
Constituents of Concern or “COCs” means a potentially harmful or difficult to treat substance that could cause treatment interference, pass-through, or a violation either of a treatment technique requirement or of an Maximum Contaminant Level (MCL) in finished water. Constituents of concern include target chemicals in Tiers 1, 2, and 3.
Constituents of Concern. (COC) means those chemical compounds which have been frequently encountered during sampling events and have been selected as having a reasonable likelihood of having been or might be released, are consistent with the Conceptual Site Model, and pose an adverse hazard or risk to human health or the environment. The COCs are listed in Attachment 3 of the Permit.
Constituents of Concern means (i) any pollutant, contaminant, waste or chemical or any toxic, radioactive, ignitable, corrosive, reactive or otherwise hazardous substance, waste or material, or any substance, waste or material having any constituent elements displaying any of the foregoing characteristics; (ii) any substance defined as a hazardous substance, hazardous waste, hazardous material, pollutant or contaminant, or words of similar import, under any Environmental Law; (iii) petroleum and any of its degradation products, by-products and derivatives, any other hydrocarbons, to the extent that any of the foregoing is subject to regulation under any Environmental Law; and (iv) asbestos, asbestos-containing materials and polychlorinated biphenyls.
Constituents of Concern means any material, substance, pollutant or waste (whether solid, liquid or gaseous) as it is defined, listed or designated as a hazardous substance, hazardous waste, special waste, petroleum or petroleum-derived substance or waste, or any constituent or combination of any such material, substance, pollutant or waste, the storage, manufacture, generation, treatment, transportation, release, remediation, use, handling or disposal of which is regulated by any applicable Environmental Law due to its hazardous, toxic, dangerous or deleterious properties or characteristics.
