Contingent Payment Commencement Date definition

Contingent Payment Commencement Date means the first day of the fiscal quarter following the fiscal quarter in which, after the “FDA Milestone” (as defined in the LipoSonix Agreement) has been achieved, the LipoSonix Product is first sold commercially to unaffiliated parties in the United States.
Contingent Payment Commencement Date has the meaning set forth in Section 2.6(a)(iii).
Contingent Payment Commencement Date means, with respect to the Contingent Payment Product, the first day of the calendar month following the month in which the FDA Milestone is achieved.

Failure to execute and deliver such acknowledgment, however, shall not affect the Term Commencement Date or Landlord’s or Tenant’s liability hereunder. Failure by Tenant to obtain validation by any medical review board or other similar governmental licensing of the Premises required for the Permitted Use by Tenant shall not serve to extend the Term Commencement Date.
