Controlled Substances Laws means The Federal Controlled Substances Act (21 U.S.C. § 801 et seq.) or any other similar or related federal, state or local law, ordinance, code, rule, regulation or order.
Controlled Substances Laws means Laws regulating the research, development, creation, investigation, testing, import, export, production, manufacturing, use, disposal, processing, transportation, handling, storage, possession, packaging, licensing, prescribing, dispensing, labeling, promotion, distribution, marketing, advertising, offer for sale, sale, and introduction or delivery for introduction into interstate commerce of any (i) controlled substance, (ii) hemp (as defined in 7 U.S.C. § 1639o(1) or any similar applicable foreign, federal, state or local Law), or (iii) any derivatives or extracts of items referenced in (i) or (ii), including the Controlled Substances Act, as amended, the U.S. Federal Food, Drug and Cosmetic Act (“FDCA”), as amended, the Laws of the U.S. Drug Enforcement Administration, the U.S. Food and Drug Administration (“FDA”), and similar foreign, federal, state, and local Governmental Authorities, and all similar applicable Laws and orders in each jurisdiction where the Borrower’s products containing controlled substances, hemp or any derivatives or extracts of controlled substances or hemp are offered for sale or sold.

More Definitions of Controlled Substances Laws

Controlled Substances Laws means the Controlled Substances Act of the United States, 21 U.S.C. § 801 et seq., the Controlled Substances Import and Export Act, 21 U.S.C. § 952 et seq. and similar state and local laws.
Controlled Substances Laws means all Laws relating to the control, regulation and enforcement of any controlled substance identified in the Controlled Substances Act of 1970 (21 U.S.C. Section 801 et seq.), as well as 21 U.S.C. Section 863.
Controlled Substances Laws has the meaning specified in Section 6.14 of this Agreement.
Controlled Substances Laws means the Federal Controlled Substances Act (21 U.S.C. § 1801 et seq.) or other similar or related federal, state or local law, ordinance, rule, code, regulation or order; (ii) "Controlled Substances" means marijuana, cannabis or other controlled substances as defined in the Federal Controlled Substances Act or that otherwise are illegal or regulated under any Controlled Substances Laws; and (iii) "Controlled Substances Use" means any cultivation, growth, creation, production, manufacture, sale, distribution, storage, handling, possession or other use of a Controlled Substance. The provisions of this subsection shall apply notwithstanding any state or local law permitting the Controlled Substances Use or Drug Related Activities. Borrower shall provide to Lender, from time to time, within five (5) days after Lender's request therefor, any information that Lender reasonably requests, relating to compliance with this subsection. Notwithstanding any provision in any Loan Document to the contrary, no direct or indirect disclosure by any Loan Party to Lender or any person affiliated with Lender, and no knowledge of Lender or any person affiliated with Lender, of the existence of any Drug Related Activities or Controlled Substances Use by any Loan Party or in connection with the business activities of Borrower shall estop Lender or waive any right of Lender to invoke any remedy under the Loan Documents for violation of any provision hereof related to the prohibition of any Drug Related Activities or Controlled Substance Use.

The provisions of this Section 8.6 shall apply notwithstanding any state or local law permitting the Controlled Substances Use or Drug-Related Activities. Notwithstanding any provision in this Agreement or in any other Loan Document securing the Obligations to the contrary, no direct or indirect disclosure by Borrower to Bank or any person affiliated with Bank, and no knowledge of Bank or any person affiliated with the Bank, of the existence of any Drug Related Activities or Controlled Substance Use on, in or about the Property shall estop Bank or waive any right of Bank to invoke any remedy under the Loan Documents for violation of any provision hereof related to the prohibition of any Drug Related Activities or Controlled Substance Use on, in or about the Property. The foregoing shall apply notwithstanding the receipt or execution of an estoppel certificate or subordination, non-disturbance or attornment agreement or other document from or with any tenant of Borrower engaged in such prohibited activity. ​
