If the Court denies, in whole or part, Class Counsel’s Application for an Attorneys’ Fees and Costs Award, the remainder of the terms of this Agreement shall remain in effect.
Court approval of the Attorneys’ Fees and Costs Award will not be a condition of the Settlement.

Within five (5) business days after the Maximum Settlement Amount is deposited into the QSF, the Settlement Administrator shall issue and mail checks for the Service Award, the Settlement Administration Expenses Award, and the Attorney’s Fees and Costs Award to the respective recipients thereof.
Subject to the Superior Court’s availability and direction but no sooner than thirty (30) days after the Notice Deadline, a Fairness Hearing shall be held for the Superior Court to determine whether to grant final approval of the Settlement, including Class Counsel’s Attorney’s Fees and Costs Award, the Settlement Administration Expenses Award, and the Service Award to the Plaintiff.
All requests for publication costs will be considered individually under the Publication Costs Award scheme.
Direct that Class Counsel shall file their Motion for an Award of Attorneys’ Fees, Expenses, and Costs Award and Motion for Case- Contribution Awards to the Class Plaintiffs at least fourteen (14) Days prior to the Objection Date.
Subject to approval of the Settlement by the Superior Court, the Company agrees to deposit the Maximum Settlement Amount into a Qualified Settlement Fund (“QSF”) set up by the Settlement Administrator for purposes of processing the Settlement and paying the Service Awards, the Settlement Administration Expenses Award, the Attorneys’ Fees and Costs Award, and the Settlement Awards.
For these reasons, among the others stated herein, Class Counsel respectfully ask the Court to grant the Attorneys’ Fees and Costs Award, and Class Representative Service Awards, in the requested sums.
Any Class Member who does not object in the manner provided for above, will be considered to have approved the Settlement, to have waived any objections, and shall be forever prevented from objecting to the fairness or adequacy of the Settlement, the plan of distribution of Settlement Class Members, Class Counsel's Fees and Costs Award, the Incentive Awards, the claims process or any other aspect of the Settlement.
