The Board of Higher Education acting through the Council of Presidents agrees to enable bargaining unit members, who so elect, to participate in any Dependent Care Assistance Program (DCAP) or Health Care Spending Account (HCSA) that is generally made available to employees of the Commonwealth.
The Association and the Board of Higher Education acting through the Council of Presidents shall each designate a spokesperson who shall be the authorized agent of each party in the discharge of its responsibilities under this Section.

The Chair of the Council of Presidents and the Board of Directors of the Massachusetts State College Association may meet at other times and for such other purposes as either party may request and as they may mutually agree.
The parties also recognize and agree that the Board may, in the discharge of its responsibilities hereunder, act through the Council of Presidents.
The parties agree to establish and maintain a joint Employee Relations Committee, which shall consist of three (3) unit members appointed by the Association, acting by the MSCA, and three (3) management representatives appointed by the Board, acting by the Council of Presidents.
The Classification Appeals Committee shall be composed of eight (8) members; one (1) appointee by the Board of Higher Education; three (3) appointees by the Council of Presidents; and, four (4) appointees by the Union for a period of two (2) years.
The Board (acting by the Council of Presidents) shall make available to the Association, upon the written request of the Association or of the President of the MSCA and within a reasonable time thereafter, such statistics and information related to the collective bargaining unit in its possession as are necessary for the implementation of this Agreement.
